Ummmm.... Hello, Dumb A$$ Chicago.... The cop probably left the weapon at home. I mean, he didn't need it according to Jessie Jackson. Besides, thought there was a city wide ban... no cop should have to carry a gun to a knife fight. LOL

Chicago Woman Wins $7.9 Million for Rescuing a Police Officer in False Arrest Claim
Quote:

June 14, 2008

Rachelle Jackson, a southside Chicago woman, won $7.9 million dollars in her federal civil rights claim. “Rachelle is a hero, and the jury knew it,” said Christopher R. Smith, one of the attorneys for Rachelle Jackson.

On November 19, 2002, Rachelle Jackson heard twisting metal and ran to aid the occupants of a Chicago Police vehicle that had been in a car crash. The car caught fire, but Rachelle rescued Chicago Police Officer Kelly Brogan from the car anyway. Many residents responded to aid the officers. During the chaos, someone stole the service weapon of Officer Brogan’s partner, who lay slumped over the steering wheel unconscious. Rachelle went to the police station to be a witness.

Once there, officers subjected Rachelle to over fifty hours of coercive and abusive interrogation, without access to a bathroom. Days later, Officer Kelly Brogan, who Rachelle rescued, came forward with a lie that Rachelle Jackson had attempted to remove her star and steal her gun; Rachelle claimed she pulled the officer from the burning car. After over ten months in jail, Cook County Circuit Court Judge Schultz exonerated Rachelle of wrongdoing, just as the federal jury did yesterday. The eyewitnesses, except for Officer Brogan, all corroborated Rachelle’s story.

The jury found in favor of Rachelle on six claims, as follows: Federal False Arrest - $150,000.00; State False Arrest - $250,000.00; Coercive Questioning - $500,000.00; Length of Confinement - $1,000,000.00; Malicious Prosecution - $2,000,000.00; and Intentional Infliction of Emotional Distress - $4,000,000.00.

"Officer Brogan’s attempt to jail a woman who rescued her and the detectives that encouraged Brogan to do so reflects the integrity of the Chicago Police Department,” said Daniel Alexander, lead attorney representing Rachelle. “Peoples’ rights can be, are, and will be protected in Chicago,” said Christopher R. Smith, speaking after the verdict.

I have an aquaintance who is a Chicago PD officer. This is his rebuttal of this story.

---------------
Would you like to hear or see what the MSM didn't tell you? Let's see, where do I begin? How about how the "plaintiff" is identified by witnesses in the crowd that formed AFTER the Police and fire department had responded and secured the scene. A citizen walks up to an Officer and whispers that the "plaintiff" who is standing in the crowd is the one that helped take the Officers gun. How about a signed statement from the "plaintiff" admitting to her part in the battery to the copper and the subsequent theft of the gun? How about her identifying her accomplice and telling the detectives that her friend took the coppers gun and then gave it to his uncle? How about the detectives catching her accomplices uncle with the gun as he tries to pawn it for some dope money? How about her demonstrating how she held the copper in a headlock as her "friend" took the gun, all of which was videotaped? Is any of that good enough for you to question the wisdom of the jury pool here in Crook County, the competence of the attornies that are assigned our cases or the lack of justice in some of these verdicts?

I don't know how it is in the rest of the country, but having testified several times in federal court, I can assure you that the deck is stacked against us from the very first second that we step in the courthouse door. What will more than likely happen is the City will appeal, the award will be reduced, she will get something just to go away and the coppers and the CPD will have to live with another black eye.

One more thing. The IDPR reveals no nurse with the same name that the "plaintiff" uses.

.............They supposedly have ALL THAT PROOF, and they can't make the charges stick?

So, either we believe the Article....which makes the C.P.D. look STUPID!

-OR-

We believe your "Aquaintance's" version....which makes the C.P.D. look STUPID!

Lets see, both local and federal court clear her of all charges and award her 7 million. But still there is someone with the department telling "the rest of the story", hmmmmm.

I am a high supporter of police, but really, can anyone in Chicago say the words "lose prevention"

As they toss a women in jail for 10 months didn't someone say "ya know, we may loose this, this may look bad, there may be lots of court costs, has anyone found the gun, by the way, sure would be nice if this lady actually had the gun, we are just talking about a gun right?"

The problem is, the only one thinking that way was probably the Cities lawyers, and they are the only ones who will profit, win or lose. They are the least reliable decision makers, in the end, they get paid either way.

Very well said!!!!!

I am just guessing but I bet they could have used the jail space for someone who sells crack, rapes people, or steals cars.

Send a message via MSN to Esley
If there were really video evidence of this the nurse would still be in jail.

Seems like a reasonable settlement to me.

Just wondering where the missing weapon went. Pretty lousy job of investigating the missing weapon, unless of course, someone was just looking for a scapegoat.
