I'd like to think i could tell the difference between a "fake baby" and a real one....althoughi don't know. I probably would have drawn down on him and told him to put down whatever it was (real or fake) or face action. Depending on him would have determined the outcome.

I don't know though....could i really have saved the kid based on the beating it had sustained? I probably would have shot him after warning though.

While I agree with you, there have been too many people who have killed children only to get 15 years or less in prison. That is complete BS. This guy should've been made to think about things before he died. But at least he is dead, where he belongs. If the cop didn't kill the puke then, nobody would have. If its hard to get someone the death penalty in Utah, I can only imagine what it is like in the "great state of california".

of course this story sickens me, but what is worse is that this stuff happens everyday. children are abused and killed all the time. the only reason we are reading about this is because the cop shot the useless ba$tard.

I should have been more specific, a quick death is too good for this guy....I just think a longer and more gratifying road should have been taken to get to that death...at least a bullet to the gut...

In NC you could have legally took that scumbag off the face of this earth. Law reads that you can defend someone else with lethal force as long as the person you are defending was not the agresser. And had the same right to use deadly force if they had the means.

ie. I dont think the kid started it hes a baby, did he have a deadly weapon the "father" couldnt get away from?
Immediate thread of severe bodily enjury or death.

SOB would have had alot of 45acp Gold Dots in him IMO.

I'm glad to hear that as I don't doubt that anyone here would've popped the guy but lethal force laws have gotten so absurd across the country that I could easily imagine the rescuer being brought up on criminal charges or being civilly sued into oblivion by the now-dead abuser's family.

If would have been legal in Indiana:

IC 35-41-3-2
Use of force to protect person or property
Sec. 2. (a) A person is justified in using reasonable force against
another person to protect the person or a third person from what the
person reasonably believes to be the imminent use of unlawful force.
However, a person:
(1) is justified in using deadly force; and
(2) does not have a duty to retreat;
if the person reasonably believes that that force is necessary to
prevent serious bodily injury to the person or a third person or the
commission of a forcible felony. No person in this state shall be
placed in legal jeopardy of any kind whatsoever for protecting the
person or a third person by reasonable means necessary.

I would have drawed down on him told him to stop and if he approached the child or myself, would have shot. If I was charged, it would suck, but doing nothing or not stopping it would have been harder to deal with.
