Class III?
are Class III currently being produced and sold to the public? I have been trying to figure this out for a while now. Obviously shot guns and silancers seem to still be coming into the ranks. But what about full auto etc?
I thought they were not legal to produce for the public anymore but a local gun club has a section on there website to pre-order the FN PS90. Can anyone point me to what laws effect this as well?

the ps90 is not full-auto. You are correct though that no new automatic weapons are available to the public.
As a side note they aren't class III weapons. There is no such thing as a class III weapon. and FFL Class III liscense is needed to sell automatic weapons though. |

You need a Class III license to sell, and you need to fill out Form 4 to buy.
New full-auto can still be manufactured, but can only be transferred as dealer samples or to police/LEO/Gov agencies, and cannot be transferred to the general public.

ok finally found the answer myself. there is a 1989 law banning the sale of any new machine guns to civvies. You can only get pre 89 made items with the class III stamp. Anything new can only go to the government or dealer samples to the right FFL and they can only keep it as long as they have their FFL.
At least thats what I got from the site.

There is NO federal Class III license needed to purchase a Title II (aka Class III), except a few states require their individual state license for the possession of Title II firearms and devices. You DO have to pay a one time transfer tax of $200.00, and complete the ATF Form 4 in duplicate. A dealer in Title II firearms IS required to have a Class III tax classification license to deal in Title II firearms..that's where the monicker of "Class III" comes from-the classification of tax payment in order to deal in these firearms or devices. Select fire, or full auto firearms, produced AFTER May 19, 1986 can not be possessed by non-licensed people. Only the military or a law enforcement AGENCY. Properly licensed firearms dealers can possess such as sales samples. Upon getting out of the business, they have to get rid of Post-86 Title II firearms to another properly licensed person. Short barreled rifles, short barreled shotguns, "any other weapons" and sound suppressors ARE able to be produced and ALLOWABLE to be owned by a non-licensee (Joe Q. Public) after May 19, 1986 (with the proper forms and taxes paid), depending upon your state laws. States will differ as to what a person within their borders can and can not own.
