Glad you're OK Packer; good on you for trying to help out. Just keep one thing in mind...some of these bastards will run a cop down in full uniform, with a riot gun in his hands. They ain't goin' back for that 3rd strike and a fella with a gun, cop or not, is just an occupational speedbump as far as they're concerned.

I'm glad you didn't fire any shots. Your life would have become grossly complicated and the word 'lawyer' would probably have replaced 'beer' and 'TV' in your vocabulary for awhile.

if not mentioned afore, the WalMart at Stapley and US 60 in Mesa is way confused about store policy and laws.

a friend of mines neighbor walked in to the store while open carrying. him and his son were there to SHOP for groceries. this guys wife works for WM corp also.

an assistant manager freaked and told him to leave or he would call the cops.

the customer dialed Mesa PD for the assistant manager


this store has such a high crime rate, they have a Mesa PD office on site at the front entrance. they have several plain clothes LEO's on regular duty there also.

Mesa PD said to not worry and continue on with shopping.

LEO on site would not even involve themselves with the incident.


guess where Im shopping this weekend !!!

D. THIS SECTION IS NOT LIMITED TO THE USE OR THREATENED USE OF PHYSICAL OR DEADLY PHYSICAL FORCE IN A PERSON'S HOME, RESIDENCE, PLACE OF BUSINESS, LAND THE PERSON OWNS OR LEASES, CONVEYANCE OF ANY KIND, OR ANY OTHER PLACE IN THIS STATE WHERE A PERSON HAS A RIGHT TO BE.
You need to read the AZ Burglary statues for Section 13-507, if it was Section 13-1506 then you would be covered for using force to stop the crime. However, you did not use any force you pursued / chased the suspect. He attempted to run you over with the car so use of Deadly Force to protect yourself would have come into play under 13-404.

13-1507. Burglary in the second degree; classification
A. A person commits burglary in the second degree by entering or remaining unlawfully in or on a residential structure with the intent to commit any theft or any felony therein.
B. Burglary in the second degree is a class 3 felony.


13-1506. Burglary in the third degree; classification
A. A person commits burglary in the third degree by:
1. Entering or remaining unlawfully in or on a nonresidential structure or in a fenced commercial or residential yard with the intent to commit any theft or any felony therein.
2. Making entry into any part of a motor vehicle by means of a manipulation key or master key, with the intent to commit any theft or felony in the motor vehicle.
B. Burglary in the third degree is a class 4 felony.

I never said he should use his weapon and he didn't. The weapon wasn't a factor. Forget the weapon. He chased a BG when most people would just look away.

I also noticed that he had a female passenger as well. I was able to get a decent description and license plate which I passed on to the cops.
The owners finally come out of WallyWorld and we tell them what happened. They were very thankful that I tried to get the guy. The cops were cool too. I told the officer that I had CWP and that I wanted to draw down but didn't. He said of course that I did the right thing. I wanted to ask him if I did draw down on the guy If I would have been arrested but forgot to ask.
I'll tell ya, I was running as fast as I have in some time. If that guy kept running, I would've ground him into the parking lot.
Pack your my man, but I gotta disagree with you this time. Theres never a reason to put yourself in danger to defend property. It's so not worth it. Thats why stores tell clerks not to chase shop lifters. Its not worth getting shanked or shot because some stupid lady left her purse in the car. I woulda' attempted to call the cops and get the plates maybe, but thats where it ends. Trying to save the day can get you hurt. Glad your alright though man.

that was incredibly stupid............................................ ..and cool. if more people were like that this world would be a better place. too bad he didn't reach in his pocket or waistband, then the chase would have ended differently. glad you're okay and hope someone wastes that dirt bag. +1,000,000 for you. stay safe and i would buy you a beer, but i'll drink one for ya!
