Also instead of hiding in the shadows with your tool, wouldn't you rather change the social morays by OC? If more people OC, then it wouldn't be a "taboo" any longer and we wouldn't have this case.

Hell if Rosa Parks left her seat, I'd probably be walking still...

I probably wouldn't compare open carrying of a weapon to the granting of basic human rights to all individuals.

Rosa Parks didn't wake up that day with the express purpose of testing a very stupid law, she reacted to a situation with her conscience and character.

Hardly on a level with whether or not someone can tell the world "I have a gun." by strolling down the street with it.

Still, I understand the point you are trying to make.

I don't understand why the guy would be tackled by the police. I would be more afraid of being shot by a nervous officer if I were open carrying.

Just because you have the right does not mean that everyone will agree that it is publicly acceptable. It does not guarantee that people will not mistake you for a criminal. The MSM has the majority believing that only bad guys and cops have guns. We might do better by writing articles for the local papers explaining the laws to the masses.

Here in Colorado, the city of Denver was upset with the CCW law, and also with Colorado's preemption law that was passed at the same time. So, they challenged both in court. It went to the state's supreme court, which held that preemption applied to CCW only. In other words, municipalities can ban open carry, but cannot ban conceal carry.

So now, in Colorado, you can carry concealed anywhere in the state (except the usual places like schools, courts, etc), but have to be careful where you open carry, because you might inadvertently stop for gas in a little town that has laws against open carry and find yourself in irons.

I keep a copy of Colorado state gun laws in my truck at all times. In the off chance that I have a misunderstanding with a law officer concerning state gun laws. I also never open carry!

Very expensive way to test the legitimacy of his right. I sympathize with the guy but don't necessarily agree with his way of going about OC'ing like that. Like many have said, OC is not the best way to self defense from both tactical standpoint and social standpoint. Granted the woman who posted her idiotic comments about her encounter with him is a dumb broad who doesn't bother to get her facts straight. Unfortunately, we have a lot of these types walking among us.

I hope he gets it all straightened out. As one who OCs as much as I CC I I get sick of the few times when others or even the police try to tell me that what I am doing is Illegal and I can go to jail.

Mind showing me the law?

Can you call your supervisor out here and then we can contact the magistrate.

In the few years I've been OCing I've had very few bad experiences but have had to educate more people than I can count. They always look very suprized when I tell them it's legal and explain it to them that you don't need a permit.

Update: The links to the girls blog within the original posted thread are now showing "no such entry". After a maelstrom of abusive comments, I suppose she had enough.

well, it pretty much seems like he's getting popped for the knives, not the gun. WTF?

I carry my Gerber every day, and sometimes when i worked at a print shop, i'd carry a folding box cutter like he had for opening boxes....is that 2 counts of concealed weapons? what bull****. I'm still going to maintain my position that OC is generally asking for trouble...but this just sounds like chicken**** police tactics.

We had a Marine in my shop recently get busted for concealed weapons. One was a stun gun the other was brass knuckles. He was an idiot for carrying those in the first place and on top of that he was drunk.

I thought being charged for the stun gun was BS until I looked it up in NC General Statue Chapter 14 (criminal law) and carrying a stun gun even if you have a Concealed Carry Permit is illegal.
