Gun Laws
Ok - I'm going to try and reword this post as the last one didn't get any responses. If I'm in the wrong forum please feel free to suggest where I may post this.
I'm looking to buy a new XD from an online auction type of place. I know when the seller ships it it must go through a FFL, and I have a local shop that will do that for me (for a fee of course). If I buy it and it goes through the FFL shop I know they call my info in; fine (not that I have a real choice). Now once they call me in is that gun/gun's serial number always tied to me or is it known that I just purchased a gun? I wish I could find out how my purchases are tracked, do the sellers (when a private gun shop) keep the records, etc. etc. Not looking to troll, steal, pillage, massacre or anything illegal - just would be nice to know I have at least one gun Mrs. Obama Clinton won't know about come Jan 09. Thanks.

The dealer keeps a copy the paperwork from the transfer and the FBI also keeps a record of your background check. The FBI, by law, cannot use those records for anything but the background check. They still keep the records, though. I'm pretty sure BATFE gets a copy of the transf paperwork somewhere down the line as well.
Short answer is...There are records of your transaction.

To my knowledge, yes, they keep a record of it. The ATF form you fill out gets sent in with the serial number of your new purchase. That way if they ever find your gun somewhere at a crime scene, they can ask you about it. I believe that's one of the regulations with the FFL.
That's also one of the things people/liberals get upset about with gun shows, in that there is no record of the transfer. |
