(04-03) 19:21 PDT Redwood City -- A former Daly City police officer was sentenced today to 90 days in jail for illegally brandishing a gun after he allegedly pointed his police firearm at a suspected car thief's head and demanded information about stolen vehicles.
Alfonso Esqueda, 34, convicted in San Mateo County Superior Court of the misdemeanor firearm charge, had faced up to a year in jail.
The San Mateo County Sheriff's Office will determine if Esqueda is eligible to serve his jail term under house arrest with electronic monitoring or as part of a work-release program.
Esqueda is free after posting $100,000 bail. He was ordered to surrender May 17.
The former officer also faces a mandatory 10-year prohibition on possessing a gun, which effectively bars him from law enforcement during that period. Judge Elizabeth Weiner also sentenced him to a year of probation.
Esqueda, who had previously been an Long Beach police officer, had been on the Daly City force for about six months before the July 29, 2006 incident, prosecutors said.
He was accused of putting his gun to the 20-year-old suspect's head, screaming at the man to tell him where stolen cars were located, and then driving around threatening to kill the man if he didn't cooperate.

Dang, I 'm glad I work & live in the south.....we can still point guns at our scumbags and not be charged as a criminal.......

That cop probably just got a longer sentence than the car thief did for stealing cars.....I guess he was watching "The Shield" a little too much eh?

note he was a "suspected" car thief.

hell, as soon as they do suspect you of something, whether you did it or not, you're a suspect.

i dont want a gun pointed at my head because i was in the wrong place wrong time, suspected of doing something wrong.

although there is more to the story, i tend to believe that police should suffer the same restrictions and more that civillians have to heed.

the military can handle it. cops can too.

Wait until the Olympic torch comes through San Francisco. Protestors are expected to go wild. Wonder how many police brutality accusations there will be after that.

A few years back, in the South Bay, an officer on a police horse was doing crowd control, and some arse struck the horse. The horse kicked the jerk. After that happened. the guy wanted the horse put down. Fortunately, that didn't happen.

It cracks me up whenever I watch a Dirty Harry movie (and they want to make a new one BTW) because in real life, the city of San Francisco would have thrown the book at Harry and charged him for excessive force, using an evil .44 Magnum gun, and being a bully. And he would be convicted, thrown in jail, and toss out the key. Personally, San Francisco, along with a whole lot of other cities could really use a few Dirty Harry's.
