Traffic incidents kill far more emergency workers than anything other than medical emergencies while on duty. As my departments safety officer, if any steps I or my crews take to ensure their safety makes a few people late I won't lose any sleep. I have been too way to many service funerals already. The cruiser was not blocking the lane which the crews were working in so the truck was right where it should be.

Suit alleges more humiliating strip searches by Oakland cops

Oakland Tribune, Aug 25, 2007 by Kelly Rayburn

OAKLAND -- Six more people have sued the city of Oakland, alleging that police stripped search them in violation of their civil rights.
The latest federal lawsuit brings to 21 the number who say they were illegally searched in a humiliating fashion by the Oakland Police Department.

The plaintiffs allege that police pulled their pants down, exposing their buttocks or genitalia in public areas.
At the heart of the legal matter is the police department's strip- search policy, which attorney John Burris says has created a pattern of unconstitutional behavior by law enforcement.

"Our effort is to seek to have the policy declared unconstitutional," he said. "If you want to (strip) search someone, you take them to the police station, you take them to the hospital, you take them to a private place."
Burris, along with attorney Michael Haddad, is representing all 21 individuals.
They have filed a total of six lawsuits concerning police strip searches dating back to 2005.
Alex Katz, a spokesman for City Attorney John Russo, said Russo's office has not yet seen the most recent lawsuit, which was filed last week.
"We have to review it before we can comment," he said.
Katz said the city attorney's office has defended the search policy in court, saying the city's stance is, "The policy is constitutional."

The Police Department revised the policy in May 2004 after several complaints about strip searches were made to the Citizens Police Review Board and the Internal Affairs Division.

.......And don't even get me started on the OAKLAND "RIDERS"!!!!!!!!

that does happen from time to time.......the problem with the "stories" here is the definition of "strip search". which Im sure many peoples definitions will differ a lot. I can't see the oakland PD conducting "true" strip searches on the side of the road or in a restaurant, but undoing pants and digging around is fine, and happens all the time.

"Whistle-blower" in 'Riders' case settles with Oakland for $625,000

Henry K. Lee, Chronicle Staff Writer
Tuesday, October 16, 2007

The former Oakland police rookie whose accusations set off a criminal probe of four officers known as "the Riders" will receive $625,000 to settle a federal civil rights lawsuit in which he accused the department of coercing him to resign, attorneys in the case said Monday.
Keith Batt, 30, who now works as a Pleasanton police officer, will receive the money as part of a settlement with the city's insurance carrier, Kemper Insurance Cos. No taxpayer funds are involved, said Gregory Fox, a San Francisco attorney representing the city of Oakland.
"I think it's a very good resolution," Fox said. "This puts another potential distraction behind the city."
Batt's attorney, Bruce Towner, agreed, saying, "Keith's choice as a rookie OPD officer to come forward and report misconduct by his supervising officers made for a tough road for him."
The settlement, reached this month, ends the last civil lawsuit connected to the Riders case, in which four members of what authorities called a rogue band of officers were accused of routinely planting evidence and beating suspects in West Oakland.
The four officers - Frank Vazquez, Clarence Mabanag, Jude Siapno and Matt Hornung - were fired after Batt came forward in 2000. Vazquez remains a fugitive.
Two criminal trials ended in mistrials. Jurors acquitted Hornung of several counts in the first trial, and another jury cleared him of all charges in the second. Hornung received a $1.5 million settlement in June to settle a federal civil rights lawsuit in which he accused former colleagues of slandering him.
The case led to a $10.5 million civil settlement to people who said they were victims of the officers and a federal consent decree governing the Police Department. In March, U.S. District Judge Thelton Henderson said the department will remain under his oversight until at least 2010.
Towner said the consent decree and regular reports by an independent monitoring team "are some of the positive results of the path of ethical courage that Keith chose." Fox agreed, saying the department, under the leadership of Chief Wayne Tucker, is dedicated to "constitutional policing for the city of Oakland."
Hornung, Siapno and Mabanag accused Batt of lying on the stand and quitting the force because "he wasn't cut out to be an Oakland police officer". In his suit, Batt said the department created intolerable working conditions and coerced him to resign.
The city countered in court papers that Batt "merely quit and sued".

"he wasn't cut out to be an Oakland police officer".
Batt "merely quit and sued".

Yeah Right, I CALL SHENANIGANS!!!!

Nikon777, no not Cleveland but you can't get any closer. I work in a city that is litteraly surrounded by Cleveland on three sides. We actually run into them alot on MVA's (like yesterday). The borders are so close we both get the calls.

Parametics, mailmen, athletes etc. are NOT in a position of PUBLIC TRUST nor are they allowed to carry weapons and disarm innocent people.
