Intrastate Gun Transfer FTF?

I have a question, there is a guy here locally who lives here in Kentucky who bought a gun that I had been looking at from a Police officer in Ohio. As far as I know the gun was not shipped, it was a face to face transfer...

Now, if it is completely illegal to do so stop me now but I would like to ask this for my own personal knowledge because I have read everywhere and not found a single black and white yes or no answer.

Can a seller from Ohio meet the buyer in Kentucky at an FFL and transfer the gun without shipping it through UPS or Fed-Ex? As far as I know the two met face to face for the transaction and I would assume since the LEO was the seller he wouldn't break any laws.

So simply put, is it legal to transfer an out of state firearm from one individual to another if the two parties met at an FFL? I hope this makes sense, but I send a message to the buyer and seller and they both refuse to answer me so I'm thinking that it was just an illegal sale.

It is a grey area, most of the time if you are on the border it is okay, but, I couldn't come from Colorado and do that with a handgun in Kentucky. But to be a totally legal sale, yes, it has to go thru an FFL is it is an interstate transfer of a handgun. Longuns usually don't need to go thru an FFL for this type of transfer. Les

Kentucky law:

237.020 Right of Kentucky residents, out-of-state residents, and residents of other countries to buy firearms.

(1) Residents of the Commonwealth of Kentucky who are citizens of the United States shall have the right to purchase or otherwise acquire rifles, shotguns, handguns, and any other firearms which they are permitted to purchase or otherwise acquire under federal law and the Kentucky Revised Statutes from properly licensed dealers, manufacturers, importers, or collectors, and unlicensed individual persons in Kentucky or in any other state or nation outside of the Commonwealth of Kentucky.

So if they are completing the federal transfer papers, I would think yes

"On the border" is irrelevant. Doesn't matter if your 1' or 100 mi. from the border.

I will have to call some local shops as well to see what they say. I have passed up a few good deals on guns in Cincinnati because after shipping the price would be similar to a new gun at my dealer. The only difference would be that I got the extra magazines/holsters/etc...

I don't know much about transfers, but as long as long as you go through an FFL holder, I really don't see what the difference if a gun is shipped to or FTF at a FFL holder. I could be wrong.

If it's a handgun it MUST be transferred through an FFL. You can take the handgun to an FFL in another state but you have to transfer the handgun to the FFL who then transfers it to the buyer. Rifles and shotguns may be transferred or sold between adjoining states if there is a contiguous state agreement between the two states.

Contact the General Counsel's office at BATFE in Washington, DC for the details. They will be happy to give you the definitive answer.
