i agree.. and i would of give him one warning.. and if he took a step closer... bam...
but with 15 to 20 yards between the dad and the guy... i dont think that would of looked well in the courts eyes .. but my personal opinion.. hes on my land.. and shouldnt be.. get off or get shot

First things first I'm sure glad that your dad and you came out unharmed. Chock up another one for the goodguy with a gun stopping a theft and maybe a stabbing. I'm glad you did not have to fire at him, nobody wants to live with taking a life if not a must.. If he would have moved in on your dad I would have unloaded for sure. It is too bad that he got away but it wasn't your day to be the judge like said before. Make sure you unlock that gun before you put in the safe.

I'm not out to hurt(kill) anybody. But if your in my house and shouldn't be with a knife, stealing my sh1t, you're a dead sumbeeotch. The law here says I'm justified no matter which direction he's facing. I don't see why there's a problem defending my house,property,family,everything I work for--otherwise I'd sit it out by the curb.

Thats pretty much how I thought before I started learning the laws in the state of Nevada. I still have got alot to learn but atleast I have some sort of out line now.. Alabama, gotta look into that state, sounds interesting..

That law in Alabama was passed recently by the governor. It used to be only in your house could you use lethal force to stop an intruder/burgular. Maybe it was an attempt to stop all the lawsuits from burgulars getting wounded in their occupation since workers comp. doesn't cover it. Either way, I fully support being able to defend my life, property. The way I see it, If you're taking away my rights, I don't have to acknowledge your rights. I'm going to eat, I will check back later.

I read it as 15-20' and I was wondering why you didn't shoot him.
At 15-20 yards, it's a whole different ballgame.
Still, completely justified in brandishing the gun in my unlegal opinion.
Certainly I would have shown it to him, muzzle first, and asked him to leave.

I have read your account once more. I see that you stated that, as you came to the doorway to the garage, the intruder was approaching your father, but still had 15 to 20 yards distance between. Was it really this much distance? Did you mean feet instead?

Can you elaborate more? Exactly where was the intruder? Was he inside the garage with your father still? (If so, you must have one HUGE garage if there was 15-20 yards between them)

Did his movement immediately appear to be aggressive towards your father?

Was the intruder outside the garage? Was your father inside or outside the garage?

If the intruder was outside and your father inside, then that would definitely constitute aggression by him coming back inside with possible intent to injure or kill.

I assume you called the cops?

I think you handled it right. If he had taken a step or movement towards your dad then its time to up the anti but IMO it wasn't a cut and dry self defense.

Maybe to save the $10,000 in legal bills? I have my XD sitting beside my bed every night, but shooting someone is still the very, very last option. It would have been a real-life Tueller drill in that case, but I still would not have shot until he lunged at your dad. You did great, sounds like you secured your property and I sure as heck hope you called the cops, especially after pulling a gun!
