they are in your house, as in broke in.... regardless if they are armed or not...
The case being, I hear something downstairs, I go down and theres someone there in the dark and they turn facing me quickly and I shoot them once in the torso....?

I've always heard that you cant shoot them unless they are armed and if you do shoot them there's a chance they could sue?

Well being a smart @$$ i would say that if you can pull the trigger you can shoot anyone! but the legality issues depend on your state laws and how they view it.

If someone was ever in my house, I'd shoot them regardless... I see it as if they are in my house... they are up to no good in the first place and I would feel that my life was in danger along with my family's life's.... So, going to jail or not.... any BG in my house is getting popped, unless they get me first! :[

I wasnt posting this to see if it was legal like I wouldnt shoot someone even if it werent legal.
In my house, you will pay for it... Im not letting anyone harm me or my family.

No moats or gators here. Just a lot of guns and people that know how to use em.

If I don't know you, and know that you aren't supposed to be in my house, ESPECIALLY at night....

I am NOT going to take the time to see if someone is armed.

My wife and 5 month old son lives' depend on me protecting them.

if you shoot what you cant identify then youre in the wrong. so from what im seeing say your sons girlfriend is trying to sneak out and you in your blind want to kill something shoot her. call me crazy but if you shoot an unarmed man youre wrong.

You have to remember the magic words boys...."I felt my life, and my family's life was threatened". Here in Florida at least, there is no requirement to retreat from your home. I hope the situation never occurs but I would definately defend my wife by every method possible...if that means shooting an intruder...I wouldn't hesitate.

But that un-armed man is in YOUR house at NIGHT stealing your stuff. You dont know if he's going to harm you or not.
So I'd shoot him and you'd stand there and question him?

If his back was too me, I wouldnt shoot.. I'd calmly tell him to NOT MOVE and that if he did I'd have to shoot him.

I mean, I dont care if Im wrong.. I'd defend my family before I'd give anyone the slightest chance to harm them.
