Quick Question...

If you buy a gun over the internet that is from out of state. You pay the $500 or so to the out of state dealer, and have it sent to a FFL dealer in your state.... Do you have to pay the tax on the $500 to the local dealer?

I had one place tell me i had to pay them the tax, which was around $35 or so + the transfer fee. I had another place tell me i didn't have to pay the tax, just the transfer fee. Needless to say i went with the one that said i didn't have to pay the tax. My question is, was the 1st place seriously trying to rip me off by claiming i had to pay the tax on it, or did the 2nd place make a mistake? Also, isn't that a federal crime......claiming excess fees is a "tax" when it is not?

I've never paid taxes on anything i bought on the internet from out of state, which seemed weird.......maybe it's different for firearms?

There should be no tax on the out-of-state purchase of the gun.

Here is what I have heard about Washington State.

If you buy "anything" out of state and bring it back in, you "owe" the state sales tax. This includes internet purchases. Just because they don't have a mechanism to collect it doesn't mean you don't owe it. As the buyer, you're supposed to pay it out of your strong sense of civil duty.

My favorite gun shop here has told me that the state (probably Dept. of Revenue?) has told them they are supposed to collect tax on any firearms transfer they do, even if it is face to face in their shop. The thing is, though, the actual accountability to pay the tax rests with the buyer, not the gun shop doing the transfer. So, the gun shop may have forgotten to collect that tax on certain rare occasions. But I can't be sure of that.

Didn't think so. Stupid gun shop is a freaking rip off. If i had gone through them for the transfer, i'd be P.O.'d.

Your FFL is not to charge ANY sales tax on the transfer fee nor a background check fee. Your FFL dealer is not to charge any sales tax on a sale from another state. The firearm you purchase from an out of state FFL dealer can charge sales tax if it applies to your state, usually the website you purchase the firearm from should state that..

Some FFL's will try and tax a transfer fee(they are not suppost to do this) and or try and tax an already taxed item.. Beware of this.

Just curious, what part of the state? Sounds like a very similar experience I had one time.

Side Note: I can tell you from personal experience, some of the FFL's get grossly annoyed when a buyer rubs in their face the fact that they don't have what they are wanting and/or buying.

Looks like Florida is the same as WA. Only two things in life that are certain are death and taxes.

Edit to clarify: Most of what is said above is correct, not trying to stir up sh!t here. The gun shop does not have the accountability to collect sales tax (or use tax) at the time of transfer. Regardless, the DOR of Washington has asked guns shops to collect the tax, but it appears the gun shop is not required to comply. The point is the gun shop is not trying to rip you off, they are just intimidated by the DOR. They'd rather piss you off than get in hot water with DOR.

In my experience in AZ, you do not have to pay state sales tax on an item that was purchased out of state. You are, of course, liable for the FFL transfer fee, but beyond that, there should be no sales tax. Like I said, that has been my experience in AZ, many states have different laws regarding importing of merchandise. The fact that two shops told you two different things sounds a little fishy to me. It could have simply been a mistake made by one or the other, but it still just doesnt sound right.
