CC in restaurants?

This is from the VA State Police website. Is this the same everywhere?? It rules out your friendly neighborhood Applebee's, Outback, etc....just curious if its all other states or just a VA thing.

J3. No person shall carry a concealed handgun onto the premises of any restaurant or club as defined in § 4.1-100 for which a license to sell and serve alcoholic beverages for on-premises consumption has been granted by the Virginia Alcoholic Beverage Control Board under Title 4.1 of the Code of Virginia; however, nothing herein shall prohibit any sworn law-enforcement officer from carrying a concealed handgun on the premises of such restaurant or club or any owner or event sponsor or his employees from carrying a concealed handgun while on duty at such restaurant or club if such person has a concealed handgun permit.

In Florida, you can carry concealed in those type of restaurants that you listed, with the caveat that you have to stay out of the bar area of the restaurant.

The key word here is CONCEALED VA allows open carry of firearms. You can open carry into resturants even if they serve alcohol.

In WA state, you can carry into restaurants that serve alcohol but not into the actual bar area and there is an obvious sign saying so at each place, too.

Some restaurants will put that sign right up front to discourage CCW. I heed their advice and spend my money elsewhere.

Texas has a 51% rule. If 51% or more of the income is from alcohol then you can't carry... few actual restraunts get that much income from alcohol.

Nebraska has a similar rule. I forget the exact verbage, but it is the same principal.

How is a customer supposed to know what percentage of the business' income comes from alcohol?

In Ohio you are barred from carrying a firearm in any establishment that serves alchohol for CONSUMPTION ON PREMISES. You are welcome to walk into a liquor store but stay out of the bars and eateries.

Concealed carry laws are state-specific and restaurant carry is one of the laws that you'll find a lot of variation.

I think it is one of those "you know it when you see it" issues, although that isn't very reassuring when you face criminal charges for making a mistake despite trying to follow the law.

I'm sure you would be fine if the restaurant has a full menu, the majority of customers order food whether or not they drink, and a large lunch crowd to offset the late evening customers who order more booze than food.
