Yeah... Some people dont realize the danger... My wife, one day playfully jumped out at me after I got home from work. She did it playfully, but you have to understand that I work in law enforcement and carry a side arm... Luckily I didnt shoot her and I had to have a talk with her about that... she wasnt too happy with me....

If you ever hold a prisoner for the police, make sure you give the 911 operator a GOOD DESCRIPTION of yourself, and hopefully you're not wearing the same clothes as your prisoner! Make sure you drop the gun when told by the cops, but please don't drop it near the badguy.

As far as citizen arrests go, it depends on the state. Here in Tennessee, citizens have damn near the same arrest powers as law enforcement officers except for the right to arrest people that have warrants out on them.

Last time I looked, simple trespass is a misdemeanor; your response to that would be disproportionate, and would open YOU up to all sorts of legal action. Citizen's arrests are lawful for FELONIES, not for misdemeanors. You'd be lucky if you weren't charged with assault, battery and kidnapping (not allowing him to leave). And that's not even considering the next step:
What if he wouldn't keep his hands in the small of his back? Pistol whip him? Shoot him? Either way, you're in big heapum trouble. The minute you draw on him, you've changed the rules of the game and someone's going to own your @$$..
I am not sure about all states, but in Minnesota citizens can arrest for a misdemeanor if they witness it. Regardless, I would have drawn on him and at the very least detained him if I did not have cuffs on me until the police took custody. Citizens can also use force to make an arrest.

yes and if you do end up having to shoot and the threat is neutralized, before the police get there, empty and clear the gun and set it aside, DONT TOUCH IT! Let them handle it when they get there. This is for your safety as well as the officer's.

Even if you dont shoot, and officers get a call that there is a situation at gunpoint, expect them to be comming in guns drawn. They WILL order you to the ground and handcuff you regardless of anything... so just be expecting that. If you have sombody at gunpoint, they will order you to drop the weapon and do a felony arrest procedures.

Here in Oklahoma you can shoot an intruder in your home.Make my day law.

Why not,at first, just let him see the gun without actually pointing it at him(if unarmed and maybe just a weak little homeless person, maybe just the sight of that badboy XD in your hand would be enough to scare him enough to stand still?),telling him to hold for the cops, and calling 911.If he moves to leave, maybe then point it at him.If he tries to come forward,a shot in his direction,if he runs at you, a shot or two to the legs,if he runs for the door, maybe a few shots right at him. He's in your home,unauthorized.Period.I would think that someone climbs your fence and is in your backyard, that is a trespass. How is someone INSIDE your home uninvited,a trespass? Its not.Thats breaking and entering.

Does a criminal, when breaking into a house, think about what if someone catches me and what are they going to do to me when the do, and what am I going to do when they do?Surely they have their plans laid out?Or are these people really brazen enough to just think they can waltze in and steal some of your **** and have a sandwich and **** in someones toilet and then just leave? In that case, they should know the drill then when theyre caught in the act by one of us with a big badboy XD in our hands and a big grin on our faces.Cause he aint leavin the same way he came in if I catch em in my house.Day or night. No matter what I decide to do,I have the money and access to good legal counsel.Youre in my home unauthorized.Good luck. And I'm the freak who's up all hours of the night in case he wants to come back someday for a repeat.

911. Your mother is lucky to be alive. I'd watch your credit very, very carefully.

so.I cant pose questions and be curious?

I'm not some vigilante. But I work for my stuff as well as anyone else and who wants to let someone just come in and try to take your hardearned stuff? No one.Not me anyways.I'm also a homeowner(paid off too) with young children in the home.I dont drink or smoke or do drugs or hang out with people who do.Me and my wife work long hours to get the stuff we have and damn if anybody is going to take my ****.Period.

I was raised by a career Marine father who did his tours at the end of the Korean conflict and the beginning of Viet Nam.We lived in San Diego and Kodiak. After his service was over he worked law enforcement in Oklahoma, same as his father did when he grew up.In fact, both of my paternal and maternal grandfathers were cops and my moms dad was even chief of police.I still have his old service revolver.I got my first gun,my prized Winchester Model 290 .22 rifle w/scope when I was probably 8 or 9.Still have it.We were taught respect for the weapons. My father also ran a martial arts school from our home when I was a kid. So,being prepared for whatever happens has been drilled into me my whole life. Now my kids get it.They go to a martial arts academy and we all go shoot, the whole family, on our land or at the range,a lot.

At 7 years old I was the victim of a crime in which a man broke in to my grandmothers house, while we were sleeping in the middle of the night, put a pillow over my head, and beat my grandmother in the bed next to me.I struggled best as I could. The neighbors next door heard the screaming and came running and captured the guy, drunk, coming out the back window of the house.(He was a neighbor from across the alleys son, home on leave from the military, who apparently had been casing my grammas house for awhile). My testimony,at 7 yrs old,on the stand ,put him away for a long time.As he was leaving the room that night, his shoes(Hush Puppies) were all I could remember seeing.I havent slept a restful night at night ever since.

And I will NEVER ever be a victim ever again. Here in Tulsa there have been so many breakins and force-ins/home invasions in the last 2 weeks that every one around here in my neighborhood is on gaurd.

So.To be quite honest,I could give a ratsass what anyone thinks about my views on this subject.Come in my house uninvited and ready to get at some of my hardearned stuff and its probably not going to be in your favor.

Are you serious?!? Have you had any training with guns... ever? You NEVER fire warning shots, you NEVER shoot for the legs/arms.

Didn't mean to offend. I too believe in protecting what is mine. I was referring to the warning shots and leg/arm shots you referred to and the next poster also mentioned.
