Notice how the media called the weapon an M16 and not a AR15.

Police: Stray bullet kills sleeping man

SAN ANTONIO -- A man who killed his neighbor when the rifle he was cleaning fired a bullet through his apartment wall could face criminal charges, police said.
The shooting is being investigated as a criminally negligent homicide, San Antonio police spokesman Joe Rios said.
Anytime someone discharges a weapon, there's accountability," said Rios, who added that the shooting did appear accidental.

Jesse Hernandez, 35, said he accidentally shot neighbor Saulo Garcia on Saturday when the bullet from his M16 rifle pierced a bedroom wall. The bullet then passed through a headboard and struck Garcia, 24, in the back of the head while he slept.
Garcia wasn't found until his wife arrived home from work, about 30 minutes after the shooting.
Hernandez said he bought the rifle for protection and thought it was not loaded while cleaning it. After the weapon fired, Hernandez thought the odds of the bullet hitting someone were remote.
But when he heard Garcia's wife scream, Hernandez said he fled to his brother's house before telling police.
He said he plans to "get rid of (the rifle), and hopefully keep going on with my life."

Well I see we know who doesn't know the 4 rules of firearms safety. At least 2 people are alway affected by lack of safety. The one that committed the safety violation and the one that is dead.

Personaly after and ND i would go upstairs (or where ever the bullet went) to make sure it didnt do any serious damage, and then call the police. In and apertment, and gunshot, is gonna get em called anyhow ( I would think). THen agian, you wouldnt know he was dead till someone opend the door.

Cool Old Story

Sevral years ago (like 30 nor so now) a married couple who are friends were living in an apartment. As they sat in their living room watching the boob tube one evening they heard a boom and shattering glass coming from their bathroom. The first thing they noticed when they looked into the batroom was the mirror on their medicine cabinet was in bits.

A couple of minutes later their doorbell rang. The deputy who lived in the next apartment was standing there white as a sheep. It seems he was practicing his draw in his bathroom which backed up to theirs.

My friends were very nice to him and let him just repairs the damages and didn't report it even to the apartment complex.

I'd say they were all very lucky!

Where did the guy get a "M16 rifle" from?

I don't think the type of rifle is the issue. What is the issue is that the man did not follow the most basic gun handline rules and for that he will now go to jail (most likely). The sorry is sad.
