Maybe I'm just a cynical old fart, but:
Interesting to note that the Senate bill's author is George Allen (R-VA), up for re-election this year and tanking badly after his brilliant and witty "macaca" remark on the campaign trail (open mouth, insert foot). House bill's author is Cliff Stearns (R-FL), also up for re-election this year. Yet another "write some dumb-ass bill before the election to energize my conservative base" strategy? Don't really matter if it can pass or not, and hopefully my conservative base is too dumb to recognize that this bill is a huge assault on the fundamental principle of federalism...hell, most of 'em don't know what 'federalism' means, nor care....prolly think it has something to do with FedEx! It is so embarrassing to watch congressional Republicans this year fiddling (with cynical grandstand bills intended to pluck at your heartstrings while accomplishing nothing) while America burns.

Bad idea give this control to the FEDS. All it takes is one "bad" President to drive to overturn the law, then no one has the rights. As an example, if Billary became President, she would overturn it.

Jeff,
you are dead on right. I'm tired of half educated "conservatives" jumping on the "have the Feds make them do it" band wagon. Like "prayer in the schools". Then, we can have each generation legislate who the appropriate list of "gods" are to pray to. (We already can't use the name Jesus). And don't worry DoctorDawg, there are still some of us Anti-Federalists out there.

Amen. This would not form a more perfect union or strengthen it, so the Feds have no business in it.

Each state recognizes drivers licenses from every other state. Each state recognizes marriage licences from every other state based on its interpretation of what marriage is. Certain states recognize CCW permits from certain other states. Nothing is federally mandated here, nor should it be. Frankly, I am not a big advocate of national legislation around CCW. |

Yes, this should remain a states rights issue.
This not only makes it impossible for the federal govt. to take CCW away entirely, but also gives choices to those that WANT to live in a state where people are severely restricted on this and other gun rights. Not everybody WANTS citizens to own firearms or carry concealed pistols...they should not have to live under OUR ideas of gun ownership as WE should not be forced to live under theirs. If you live in CA, CT, NY, NJ or other "anti-gun" areas of the country...well..you DO have a choice and CAN move to where the laws more readily reflect YOUR personal views. This is the beauty of having DIVERSE gun laws across this land. ...see, diversity is not all bad. - Brickboy240

I think it's a constitutional full faith and credit issue. By the constitution, each state must recognize another state's pronouncements such as marriage, divorce, judgments, etc. A state not doing so violates the full faith and credit clause of the Constitution (securing the right to have one state's marriage or divorce decree, etc recognized by all other states.) Without this right, you would need to marry your wife / husband in every state you visit. One wedding was enough for me.
The issue becomes thorny when dealing with the gay marriage question. IMO "marriage" should be somehow federally defined (either via statute or Constitutional amendment) to be "one man and one woman." This would eliminate the question of which marriages can be nationally recognized. The problem lies with the fact that when all the marriage laws were written, the notion of same sex marriage had basically never been thought of. I guess people thought Marriage was a word that didn't need defining.

Screw all this! The 2nd amendment say I have the right to bear arms. That's all the law we should need. If I choose to bear those arms concealed that is my choice. What's all this talk about state law vs federal law.
THERE SHOULD BE NO CONCEALED CARRY LAW AT ALL! Get your federal and state law off my Second Amendment rights please! If I can legally own a firearm (ie not a felon) then I should be allowed to carry it however I like. Ranting and Rambling mcb |
