Actually under this revision you would have to grant the password of the public key and give them access. Or pack your tooth brush an KY...you'll need it.

I think the point of the ruling was, this person was a convicted felon, with past child porn charges....
Once you have a felony conviction, let's just say your rights are a little 'different'. But, still a bit of a surprising ruling coming from the 9th circuit.

I don't agree that my personal and confidential info on my laptop's hard drive should be opened up for inspection and detailed search through customs or anywhere else. It's an invasion of privacy. It's wrong. It's none of their frickin' business what's ON the drive. They should only be worried if my laptop is truly a laptop or some sort of IED.
The fact that this one instance helped to catch a child pornography viewer on probation is moot. We're talking about our privacy. And how much more the government gets to stick its nose into our private lives. It sickens me as to how opened up to the public our supposedly private info has become. Makes me glad I don't travel anywhere.

Okay, so how about a hypothetical (but entirely possible) situation. While outside the country or before exiting you check your e-mail as usual. Assuming you have one, your spam blocker sometimes misses illigitamate e-mails. One of the spam e-mails you delete happened to be from a site featuring child pornography, perhaps you don't even realize it was there at the time. When you get back to the States, security thouroughly scans your computer, because they can, and find the images from the e-mail you may not have even known existed. Naturally you are arrested for posession of child pornography, and strictly speaking you are guilty.
I recall my computer networking professor mention this to be one of the reasons companies so thoroughly prevent spam on their networks. They not only have to worry about liability from employees being exposed to sexual matierial, but they are also liable for any data on the network that violates the law, like child pornography. I think this a perfect example of why the "if you are innocent you have nothing to hide" theory doesn't work in practice, even if maintaining constitutional rights isn't quite important enough.
