Without any facts of the case, best leave it up to the cops and the jury. Sad story all around.

NC law prohibits the use of deadly force solely to protect property, or to prevent theft, or to regain stolen property. A different rule applies if life is immediately threatened at the same time (i.e. burglar tries to stab owner). In that case, deadly force is allowed since it applies to the defense of life. So it's going to boil down to what the victim said or did during the course of the robbery and how the jury sees it.

The kid's father said "He didn't deserve to die".

The owner of the produce stand didn't deserve to have his cash box stolen, either.

I'm willing to bet there will be a significant drop in these types of robberies in those parts. Truly a sad story, but based on what's there I would side with the produce stand owner. The charge of second degree murder seems premature.

Notice he shot him in the chest, not in the back. I wonder if there is more to the story that isnt being told. The kid may have been unarmed, but it may not have appeared that way to the owner of the cash box....
