Bad Shoot!

This is a discussion on Bad Shoot! within the XDTalk Chatter Box forums, part of the XD Talk category; I can't believe this story. A lawyer frightens an intruder, then "fires in self defense." Yeah... RIGHT. Bad shoot, and makes us all look bad. ...

Lawyer Awakened by Apparent Burglar as He Slept in His Office Shoots at Fleeing Suspect

Two burglary suspects are in custody after a Florida lawyer sleeping in his makeshift office apartment heard a noise and confronted an intruder with his shotgun.
Sam Bardwell of Titusville told Florida Today he was awakened by the sound of a motion-triggered fan around 4 a.m. on Monday, and noticed a motion-sensor light had gone on. The 60-year-old criminal defense lawyer recognized danger, “so the first thing I was going to do was get myself a gun,” he told the publication.
Bardwell cornered an intruder, who ran from the building. “He was out of range to really kill him, but I wanted to put some pellets in him so they could catch him,” Bardwell said. He fired, but the “bullets went wild,” striking a stop sign.
Police arrested two suspects outside the Titusville courthouse with the help of a police helicopter, the story says. They are suspects in five other burglaries that occurred the same night.
Bardwell said he never represented the suspects and he doesn’t think he was targeted. “I’m just a great advocate of people arming themselves,” he told Florida Today. “Some bad things could have happened had circumstances have changed a little bit.”

All those who say they will shoot no matter what need to pay attention here. A felon who is running away and presenting no emminent danger should be left to the police. However in this case like all others the full story may not have been told yet. If it is as presented, the lawyer should be charged with discharge of a firearm and reckless endangerment. There should be a full investigation into this.

"Despite not being in any current danger, I willfully elected to discharge my firearm knowing full well I was unlikely to hit my target."

This guy is also an awesome lawyer. "Bullets went wild" Legal speak for "Crappy shot." He should shut up, he's talking himself into a conviction.

Retard is lucky he didn't hit a random 3rd party.

Edit: I don't know if it was bad information in the comments, but if it was seriously an AR-15 or similar type weapon he just started cranking rounds off without aiming, he's lucky he isn't in jail.

This debate is all too familiar here in Winter Springs, 10 minutes from Sanford, FL and the Trayvon Martin shooting.

Personally I'm all for "stand your ground", but the law is so vague to some people, they assume they can get away with anything.

Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:
(1) if he would be justified in using force against the other under Section 9.41; and
(2) when and to the degree he reasonably believes the deadly force is immediately necessary:
(A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or recovered by any other means; or
(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.
