WI care workers- Illegal to use self defense weapons? ASAP!
A friend of mine works in Jefferson County, WI. She was attacked by a client (slight mental retardation). Her company told her it is agasint WI law to use any self defense tools, firearms, pepper spray, knifes, etc against your client even if you are in immediate danger.
(She received a concusion, nasal contusion, and multiple laserations to her arms, neck, and face yesterday) I belive these statements to be company policies and would think that state and federal laws to the right of self defense trump these policies. If it is a WI law I will accept that. She is carrying pepper spray with her today to go turn in the paper work there. She is not allowed to work or even go to her college for 1 week. Please help me find the state law that suspossibly says even in immediate danger a care worker can NOT use self defense even though you can on the street from humans, animals, and mentally ill/diseased humans and animals. What is the difference? If this is a law it inferiates me and I will be contacting everyone I can. I will try contacting my county's DA as well today. Thanks to everyone who can assist me. |

In OH it is illegal to carry a concealed weapon (or any weapon for that matter) into a mental health facility. This is the only law I have ever heard of that even comes close, but that is in OH though.

What about only assisted living and not a mental health facility?

Is there any law that says she can't beat the crap out of someone with her fist tho? If she's in a mental health facility, then I'd assume no weapons of any kind. You can't even have anything glass in there. It's understandable. But if that were the case and I was involved, I'd beat someone with my fist if I had to in order to protect my life.

You have to except some things
Working around people who have mental problems puts you in a area like working with children. When they get out of control you can't deal with them as you would normal people. You just have to except some things and deal with them without using any force that could hurt them. They are protected under your States laws. You on the other have have no real protection.. Sad but it's true.

Well that doesn't justify, not being able to defend yourself that is. The only reason I would go along with this is because I want my freedom, not to be jailed for defending myself.

Same thing in the health care industry. Your pooper is going to court if you do anything more than raise your arms in self defense.

Interesting I didn't mean to blurp about obvious things, I guess(it would be wrong to attack a mentally challenged person..) Trust is a major issue when in the company of "children", and a back up taser would be a good idea though it may get the leo nowhere having to drag a limp body.
