Gun sale question...?

I will be buying a gun from a friend in the coming weeks. I live in NC. How do I need to go about making this gun transaction legal. Is there any paper work that needs to be done. I have never done this before just wanted to cover all my bases. Thanks.

thats the same way in Oklahoma, it is how ever normally a good idea to do a Bill of sale with both parties signature incase of futher legal ramifications, say it ever come into question as to when you originally came in possesion of it.
but thats just my opinion

Just ask a gun shop the same question here in KY. All you HAVE to do is trade gun for money (or however you want to trade). But it is a good idea to write a reciept out with the guns id number, name, drivers license number, as well as other info. for your own sake.

Exclamation Paperwork & FFL

Definitely do a Transfer Of Ownership document which reflects the change of hands and specific date and time you acquired it.

One more observation:

Not trying to insult your intelligence but since you asked, one more thought to process for ya. IF SHIPPING....the gun cannot just be shipped via USPS Mail as you'd normally mail any other package. It has to be shipped via UPS or FEDEX and documented going to an FFL for receiving and processing. Check into the requirements in your state specifically.

Good Luck with the deal

Since firearm sales are regulated on a State basis it would be worthwhile to call a NC Law Enforcement Agency and verify.

In Maryland, private sales of handguns must be transferred through either an FFL holder or the State Police:

Private firearms sellers (persons who are not licensed dealers) must process transfers of "regulated firearms" (handguns and assault weapons) through a licensed dealer or designated law enforcement agency. Md. Code Ann., Pub. Safety § 5-124(a). In addition, no regulated firearm transfers may be made to any person whom the private seller knows or has a reasonable cause to believe is a prohibited purchaser under state law. Section 5-134(b).

Q: I want to buy a handgun from a friend. Do I need to get any sort of permit to buy it?
A: Yes. All handgun transfers in North Carolina, whether through a dealer or via private sale, or presented as a gift, require that the intended recipient of the handgun obtain a Pistol Purchase Permit from his/her local Sheriff. You must go to your Sheriff, apply for a Pistol Purchase Permit (one per handgun you wish to purchase), and pay a $5 fee. When you take possession of the handgun you must present the Permit to the seller, who is required to retain it forever. If a Pistol Purchase Permit is not presented, both the buyer and the seller can be convicted of a Class I Misdemeanor.
As of 8/10/04 a new law was enacted, which permits someone with a valid North Carolina Concealed Handgun Permit to purchase a pistol without the need to obtain a Pistol Purchase Permit.

In NC you will need a valid handgun purchse permit or a valid concealed handgun permit. You will need to do up a receipt that says effectively "I (your friends name here) on this day sell this firearm (serial #) to (your name) with a pistol permit #/CCW permit # such and such.

both parties sign it, your friends fills out the sale information on the pistol purchase permit, and technically he's required to send one of the copies to the local sheriffs office, most of the gun shops around here don't do it though.

He has to keep that paper for his records in case the cops ever come knocking looking for that gun, you do not want to be the last person in the chain of ownership with no proof of LEGAL sale.

I just moved but i'll try to find my receipt for my super redhawk that I bought that way and scan it so you can see what i'm talking about, it's nothing real formal, but you can always go to a gun shop and pay them the $25 transfer fee if you're worried about doing it right.
