People die from stun guns all the time. I mean, I know it's not a certain every time thing, but it happens.
Considering this, I would draw and fire. I'll let the jury decide later, after his funeral.

The term "less lethal" is quite misleading. People have died from stun guns, people have died from tazers, people have died from shotshell beanbags, people have died from rubber bullets, and people have even died from OC/mase/pepper spray.
FYI: Did you know that a professional boxer's fists are considered lethal weapons (and are required to be registered in some states as such)? Experience in martial arts can also be considered as a lethal weapon with intent to do harm. I believe that any confrontation in which your life or the life of another is justification. My life is definitely in danger when confronted with a stun gun specifically.
