I don't know legally (the letter of the law), but I wouldn't convict you if I was on the jury if you could convice me that you thought once stunned they may kill you. It wouldn't take much convincing either.

even though by florida law I could stand my ground and shoot, I would draw & attempt to retreat. If they kept after me, well, let's just say that would be bad for them.

If I KNEW it was a stun gun, that would be a tough call.

I'd say yes. How do you know that once you're incapacitated he's not going to take your firearm and kill you with it?

However, there would also be the fact that some guy was attacking me with a small, black, unknown object that could quite possibly be a gun, and I had to react fast enough to avoid getting shot.

In the end, all you REALLY knew was that he came at you with a weapon of some sort.

During training we were told that we are allowed to use lethal force if someone was trying to use a stun gun or OC on us as it has the potential to weaken or remove the means to defend your self.

I'd draw, put my finger on the trigger, and push it into their chest.

I'd let the muscle contractions from the the stun gun do the rest!

I most certainly would shoot....Im a bigger guy so im not so sure id come out of a good tasing. Not to mention once im tased i doubt i can protect myself or my weapon.

if your stunned, your out cold in essence, so they can do whatever their imagination deems ideal to you and you wont know it...

i would draw if someone pulled a stun gun, but instead of saying "drop it"

i'd say "Don't taze me bro"

I voted no... But upon further consideration, I would probably both draw and fire. My issue is that a persons right to defend themselves can be legally grey depending on where you live and who your jury is. I agree, the prosecution will certainly bring up the fact that a taser is non-lethal, and as such say that lethal force in response was unwarranted. Just make absolutely sure that the person has the intent to actually use the taser. I view it as a 50/50 chance that could go either way... Which is 50% better than the 0% knowledge you have regarding the assailant's intentions. Better to be judged by 12 than carried by six after all.
