While walking in you saw nobody else there. If you shoot you have a chance of hitting the robber in the back and side. What do you do?

This one item changes the entire scenario from a robbery to a murder attempt. In this situation you have only 2 options. You can run away and leave the clerk to their fate or you can engage the shooter and possibly save the clerk at risk to your own life.
I would choose the second option because I will not stand by while another person is murdered. If that means I have to shoot the bad guy in the back, all the better, because I will have a better chance of success.
I can't imagine any DA would prosecute you for defending another person.

Another vote for shooting him.
If he's trying to take a life, you have every right to prevent it. I would consider it a personal duty.

I was expecting a question of if it was getting held up, would I shoot (which I wouldn't be able to answer, it depends...) However, if the guy went in and started shooting, I'd say that pretty much justifies me pulling the trigger.

In the situation that you describe I'd shoot the robber (in the back and side if need be) providing doing so doesn't put the clerk in any more danger (i.e. directly in the line of fire).
If he had not fired his gun and had just pulled it out I'd probably also yell something as a verbal warning like, "Drop the gun or I"ll shoot!", but since you say he's already fired/firing his gun the only feasible option for me is to shoot him.
