A sad day for America -- Supreme Court: "No death penalty for child rape"

Supreme Court Rejects Death Penalty for Child Rape.

WASHINGTON - The Supreme Court on Wednesday outlawed executions of people convicted of raping a child. In a 5-4 vote, the court said the Louisiana law allowing the death penalty to be imposed in such cases violates the Constitution's ban on cruel and unusual punishment.


"The death penalty is not a proportional punishment for the rape of a child," Justice Anthony Kennedy wrote in his majority opinion. His four liberal colleagues joined him, while the four more conservative justices dissented.


There has not been an execution in the United States for a crime that did not also involve the death of the victim in 44 years.


Patrick Kennedy, 43, was sentenced to death for the rape of his 8-year-old stepdaughter in Louisiana. He is one of two people in the United States, both in Louisiana, who have been condemned to death for a rape that was not also accompanied by a killing.


The Supreme Court banned executions for rape in 1977 in a case in which the victim was an adult woman.


Forty-five states ban the death penalty for any kind of rape, and the other five states allow it for child rapists. Montana, Oklahoma, South Carolina and Texas allow executions in such cases if the defendant had previously been convicted of raping a child>>>>
What a sad day for America. This kind of crap pisses me off.

So apparently only the life of a child is worthy of the most severe penalty the courts can deal out. I'm sure that's a great comfort to the many parents and family members of children that have been raped, molested, and sexually abused.

I'm sure the many perverts and child predators will take comfort in knowing that as long as they don't kill their victim they're in the clear.

Well, this follows suit with the whole "child pornography is covered under the constitution" bit the left loves so much.

It's weird seeing you guys all bent out of shape about this... it's not like the death penalty has been around for a long time for this crime. Only recently did this legislature decide that the crime deserved the death penalty! In the decade or so that the law was on the books (and un-challenged) VERY FEW other jurisdictions passed a similar law. So vent all you want now, but where was your righteous indignation when your legislatures failed to pass a similar law in your jurisdictions?

Just thinking out loud here ..... if you include child rapists in the death penalty then what would keep that from morphing to include adult rapists?

Personal opinion but I feel like the SCOTUS made the correct decision even though child sexual abuse/rape is as heinous as a crime can get without killing someone.

I think its funny that the law in many states specifies that you can use deadly force to stop someone in the act of raping a child, but after the bastard does it you can't execute him that is nuts.
