Scope of Heller case...
Speaking of the DC handgun ban in relation to the DC v Heller case, a Georgetown University law professor said the following: "There is almost no other enacted gun law that would be threatened by this case."
Seriously? We have the interpretation of the 2A before the Supreme Court and he thinks that the only thing at stake is the DC handgun ban. I don't think so! I think that it could be hard to overestimate the breadth of this decision for our near future of gun rights in the nation.

if the sup court rules against the overturn of the dc ban, it could be used to overturn other pro gun laws i think

Very true. We'll begin to know what plans to make after this is picked over and analyzed to death. Third week of June is the ETA for a decision, right?

The entire future of our country is at stake. If the Supreme Court overturns the repeal of the gun-ban, then far-left groups--including the ACLU and others--will be able to use this decision as precedent to file anti-gun lawsuits THROUGHOUT THE NATION. Such a decision will give them everything they need to institute whatever gun laws they want. It will be the beginning of a thousand years of darkness if we get a SCOTUS ruling AGAINST the 2nd amendment.
On the other hand, if the supreme court UPHOLDS the overturning of the DC gun ban on 2A grounds, there is a great chance that our gun rights will never be threatened again--at least for for at least a century or so. SCOTUS precedent upholding the 2A as an individual right would give the NRA and other groups precendent to file lawsuits seeking the overturning of anti-gun laws all over the country. NO MATTER HOW YOU ALL FEEL ABOUT BUSH.....if his Supreme Court judges end up saving the 2nd Amendment as an individual right, rather than a collective right, and our gun rights end up being protected and restored, we should all be thankful to him. The opposite would apply if his judges screw us. This is a huge deal folks. The individual liberties battle of the millenium is upon us. Frank

arguably, there has not been a better SCOTUS setup to get a 2a favorable ruling than there is now. again, i'm cautiously optimistic.

for those who say "whoever the President is, doesn't matter", well, this is why it matters greatly... Suppose Hillary or Obama, instead of Bush, had appointed the last two Supremes.....
Our case would have zero chance... The 2A would be re-written permanently. |

Ultimately, will their decision really have a bearing on state constitutions? I think not. The right to regulate has always been with the state.

Not since the civil war and the 14th Amendment. Almost all Federal constitutional protections have been held to apply to the states.
with the exception of the 2nd, which has not previously been ruled upon... however, it is likely it will be extended as were the others. IMHO. |
