Whats this world coming to?? If indeed the PD broke the law, punish them for it, but why pay the 'victims'??

Send them to me for payment.......they can get on the Dr. Martin dental plan......

Unless the officer had permission of the driver, opening doors could be considered an illegal search. That might be true, but the whole reason the ACLU is suing is because they are saying that the reason the troopers stopped the van was because there were Mexicans in the van. They are trying to say that the troopers were "profiling", despite the fact that they troopers said they stopped the van because the driver failed to signal for a turn.

I don't think anything about a supposed "illegal search" was ever brought up.

I understand what you are saying though. I just think that the ACLU should have better things to do than to interfere with the enforcement of our immigration laws.

It probably went down like this. Driver violated traffic law and didn't have a valid drivers license or maybe even an ID. The officer can't just let the vehicle leave with out a driver with a valid license. The agency would be liable if the officer let the drive go and they caused and accident. Of course the officer would let anyone drive the vehicle if they had a valid license. Come to find out nobody in the vehicle has a license so then what do you do? Come to find out all are illegal aliens. It's simple, enforce the law hook, book and tow. Send the people who are violating the law back to where they came from.

If you were to be in Mexico as an illegal alien you would get 10 years in jail. I think we should send them back and bypass the taxpayers burden of jail time and 3 meals a day.

Thats my thoughts exactly. This is common practice at our department. If you cannot identify who you are, then you get to go to jail until we find out who you are. Failure to identify is a Class C Misdemeanor

+1--good analysis. I was thinking the same thing.

I still don't see how the ACLU has a leg to stand on in this case. It should make ALL of us question their motives/agenda.

Sounds good but in reality the lawsuit notes that the detention ensued even though Thomas Chabot, the state trooper who stopped the van, confirmed that the license and registration of driver Carlos Tamup were valid, and that Tamup had no criminal record. Chabot nonetheless proceeded to open the doors of the vehicle and, by utilizing Tamup as a translator, requested all the passengers to also provide identification.

And as far as not identifying yourself to an officer being a misdemeanor, only 20 states have stop and identify statutes (ohh BTW Trace - near as I can tell Texas is NOT one of those) and many of those do not require you to produce ID even if demanded (other than when you are driving of course). That of course will torque up most officers since you are challenging their authority.

Clarification - "failure to identify" in TX is only after you have been arrested so you are not required to comply with a demand for ID as stated above.
