Vehicle search question...

I work at an ultra exclusive millionaire's yacht club, yadda, yadda, yadda...One of their policies is no guns on property and they have the right to search my vehicle. I have a CCW permit. Now with the new law in Fl. that states I can bring it on property as long as it stays locked in my vehicle, can I refuse them to search? They are not LE, just public safety. I have nothing to hide. Just don't want some $8/hr ****tard finding my XD and having an AD. I have thought about requesting an LEO do the search if it were to happen. What do you guys think??

Theoritcally, they never had the right to search your vehicle without you surrendering the right (which presumably you were forced to in your employment contract).

As to the new FL law, they may still have the right to search your vehicle (see above), and the right to deny you having a firearm on the premises, but - and I'd have to reread how the new law is written - but your vehicle is YOUR property, even if it's parked on their premises. So even if they search your vehicle, so long as the firearm does not leave the vehicle while on their premises, they can't say anything about.

However, I'd almost be tempted to have a lawyer look into their right to search your vehicle.

If its like most states you are providing consent to search as part of your employment contract or part of your rights you give up to go onto the property.

If they were to search your vehicle and find a gun, the only thing they can ask you to do is leave. You are within your legal right, however they don't have to grant you access either as it's private property.

I would get a Secure-It Handgun Safe

You can wrap the wire around the seat frame in your car and not worry about people getting into your gun. If asked, you could say that the contents are your valuables and you refuse to open it.

That safe seems great, but if you read all of the lowest rated reviews it doen't seem that great.

I think a gun safe is a good idea. Not sure about the security of the product you posted. It would be easier to hid. I've got a Mini Gunvault and it would work great. You could secure it via bolts even.

I'd like to find MI's laws regarding this as well...I KNOW my employer does not allow weapons of any kind on the property, but is it illegal to choose to disobey that?

I mean, I have no intentions of ever using my weapon while on work property, regardless of the situation. I'm never near my car anyways. But if I go anywhere after work I'd have to go all the way home just to get my gun.

I dunno...it would certainly suck getting caught...

From what I've read in various places, Legally you have nothing to worry about, being that even though you are on their property, your car is your property, so as long as the weapon does not leave you car legally you don't have anything to worry about.

BUT depending on how much of a a**hole your boss is, if the weapon is found in the vehicle they can ask you to leave or even terminate you on the spot.

Did you sign any kind of form allowing them to do search your vehicle when hired? Where I work here in N.C., I signed a form when I was hired allowing them to search my vehicle parked on the property(it's a low class blue collar place of employment). However, I don't park on their property, I park on a public street. Which I had to use once as they are strict about any type of weapons here and on one of their crackdowns I was asked if I had any on my person or in my vehicle. My reply was no to the first and none of your business to the second(course I have a gun in my truck). When they said they were going to search my truck I told them they had to call the police as it wasn't on the company property. They weren't happy with it but I still am employed here and still park on the street.

Specificly:

Employers also are prohibited from taking a number of actions against employees who legally carry firearms. Among the provisions, employers also cannot:
  • Ask about the presence of firearms in an employee's vehicle.
  • Search an employee's vehicle for firearms.
  • Take action against an employee based on any verbal or written statement regarding the possession of a firearm in a private vehicle.
  • Make employment or hiring decisions based on whether an existing or prospective employee has a permit to carry a concealed weapon.
  • Condition employment on an agreement that prohibits an employee from keeping a legal firearm locked in his or her vehicle if the firearm is kept for legal purposes.
  • Terminate or discriminate against an employee for legally carrying a firearm, as long as it is not exhibited on company property for any other reason than lawful defensive purposes.
The law does not apply to vehicles that are owned, leased, or rented by an employer. It also does not apply to schools, correctional facilities, nuclear power facilities, or facilities housing a business that deals with explosive or combustible materials.
