Good story. Good ending.

Grandpa had quite the modern Colt 1911.....certainly not what I was expecting. (figured a WWII Colt...just goes to show...never assume! LOL).

Peace,
D.

Yeah, I though the cuts in the slide on a colt were vertical and not slanted. Looks like a fairly new pistol to me. Of course I just broke one of my own rules, "Better to keep your mouth shut and appear a fool, than to open it and remove all doubt."

LOL

Tell the locale paper the story, find a good will attorney, call the locle news station and tell the locale police chief... shame that sucker. Even post signs at his hang outs tell the whole damn world within a few miles of his home how he lied and took advanage of your grandmother. Shame take sucker, it work wonders. I bet you he will cough up the gun. A thief is a thief only until he is exposed than he becomes an outcast. Make it the worst $200.00 he ever spent.

He handed me the gun while my grand mother exchanged some choice words with him i pulled the clip out of the gun and began to load it.

He says to my Grandmother that now she has the gun back she has to tell everyone to give him his job back. She says no, He starts getting agitated. About that time i finish loading, I smack the clip in the gun and let the slide go chambering a round. He looks at me really worried and steps back a foot or two. I tell him that we can work this out and we should go for a walk and talk in private. I personally don't think i have ever seen any one run as fast as he did. He jumped in his truck and sped off
You are clearly guilty of premeditated misdemeanor aggrevated menacing or second degree menacing depending on your state.

Now, if he'd called the police and they had cruised up and asked you what happened and you had admitted it, you would be minus one 1911 and in jail.

If you had lied and said he's never been there but the police find out from a neighbor that they saw him there or saw him drive in or out, you would be arrested for that AND hindering an investigation or lying to an officer depending on your state.

His fingerprints on the gun would back up his story nicely and prove he was there, plus you'd have to get a lawyer and pay him about $3,000 just to get your gun back afterwards.

The law is clear and in most states reads like this:

The count is Menacing in the Second Degree.
A person is guilty of Menacing in the Second
Degree when he or she intentionally places or attempts to place
another person in reasonable fear of physical injury [or serious
physical injury or death ] by displaying a deadly weapon
[or 2
dangerous instrument] [or what appears to be a pistol, revolver,
rifle, shotgun, machine gun or other firearm].

Oh Oh. You only have to show it. By loading it and displaying it and making your statements, it takes away any doubt of 'intent' to menace and in fact premeditation is easily proved.

Have a nice night. Let me know if you need a good attorney reference in your state, I have lots of friends in the legal business.
