From what I can tell, the initial sale was not done in the presence of a FFL holder, which if memory serves me correct makes it an illegal sale to begin with. Not 100% sure on that though.

ETA: I didn't see where he drew down on him, and I don't remember the last time I heard that loading a gun is menacing.
