I am in NJ also. The Philly cop was WRONG. It is true that HR218 allows officers to carry in any state, but you carry your weapon under the same guide lines as a citizen with a carry permit does in that state. The law didnt give all cops police powers in all states. For instance, in NJ the weapon has to be concealed and no hollow points unless you are an leo. Plain clothes law enforcement officers routinely carry their weapons exposed with their badges either displayed on their belts by the weapon or around their neck. I hate to say it , being a cop too, but it sounds like the Philly guy renting a car was trying to get a Police discount for a car rental.

Im sure that the state laws for Police are different up there. In Texas specifically our City Policy says that it must be concealed. For a local State college near my agency they can carry it outside their clothes but their badge must be visible too. Most carry the badge on belt near the gun. We also have some that have the badge on a chain around their neck. Check your SOP or standard operating procedures. Its either in there or in your policy manual.

Maybe he was on official police business??? Maybe he was a detective who came to town to interview somebody?? Maybe he was part of an extradition team and was picking up a prisoner from the jail?? Maybe he told you he was on vacation because he didn't want to tell you what his official business actually was???

Just a few scenarios to think about...

HR 218 - The Law Enforcement Officer Safety Act of 2004

Also known as the "National Concealed Carry for Cops" legislation and the "Law Enforcement Officers Safety Act of 2004," this new law allows law enforcement officers to carry their weapons while off duty between states.

First, when in another state you will be subject to the use of force laws of that state. Additionally, the laws of arrest, self defense, and firearms in other states will be different and will govern any actions taken.

HR 218 will not be a defense to possessing hollow point bullets, carrying a weapon on a school campus, carrying a prohibited weapons, carrying a weapon in a casino, etc. Some of these scenarios are illegal in certain states. Know HR 218, but also know the laws of that state in which you intend to carry!

Unless the state allows open carry I'd say he was in the wrong.
