For carry without a CCW, yes. You must physically have to unsnap, unzip, etc. Friction retention would not qualify.

You can't even have the Black Hawk Serpa holster with the button mechanism. It must be a physical thumb snap.

The statue does not say it has to be a thumb snap. I would think that the Serpa probably would count as "snapped in a holster" but this all up to the interpretation of the court. A friction holster may not, as it seems the intent is an action required to remove the gun. But this is all assuming that the gun is within reach in the open and there is no CCW. If it is a glove compartment or any other closeable box it need not be in any holster at all. I think there may be precedent on this matter - I will look it up tonight and see if I can find it.

Nah, that's ok, my question was answered. The way I was reading the discussion, for some reason I inferred that someone was saying that one had to have a snap holster even in a glove box (which is getting pretty damn close to the whole 3-step rule which isn't real). The statute seems pretty clear to me on this issue though.

Glad it helped. If you plan on carrying a gun (with or without a CCW) you definitely should read the entire 790 statute. It gives alot of information that you may not even think about otherwise.

I've read it and have a few copies at home, I just haven't concerned myself much with vehicle carry without a CWFL as it doesn't apply to me. When I'm in my car I have my pistol holstered on my belt and/or in a friction type holster in my center console.
