I know here in North Carolina that if you are the person initiating the conflict you are not allowed to use deadly force, unless you try to retreat and the opposing person will not let you retreat.

I am not sure what Colorado's laws concerning this are though.

Latest update on this incident:

On 2-4-05 The DA said she will ask a grand jury to hear the case of a parking-lot shooting at a Blockbuster video store. The shooting was November 13, 2004.

also, apparently the wife never died, but who knows if she needed the blood or not. Someone just posted a link the other day on packing.org about this.

This story is still around. Today in the Denver Post http://www.denverpost.com/news/ci_2791757

It says

However, this is unofficial. The official anouncement it expected later this week.

Still seems like a long time to work through this.

from what i remembered, the shot went through the husband and hit the wife.

It is official now, no charges. Apparently, the wife was standing behind her husband when he was fatally shot. She was hit on the pass through. So far I have not heard if any civil suits will follow.

Still this was a sad incident, getting shot over a dinged door.

Good. Citizens should be able to defend themselves from getting hit in the head with pipes.

True enough. He required 30 stiches. Still it was a incident that should have been avoided. A car ding is no reason to hit a guy over the head, and not a good reason to die for.
