CCW/Open carry in the car question

Anyone have specifics on how you're allowed to carry in the car while driving? If you carry in the car, must it be concealed? Must it be in a holster, bag, etc? If it's uncomfortable to leave it in the holster, can it sit in you lap out it in the open or under an untucked shirt with the lap belt of the seat belt over it? I'm just curious about the restrictions on how you can carry in the car.

depends.... in south dakota its legal to open carry w/o a license of any kind, but you have to have the weapon on the dash of the car.

once you have a CCW permit it can be concealed anywhere its, well, concealed...

i keep mine in the door compartment right next to me while i drive, now that i have my CCW.

On the dash? That's interesting...doesn't it slide around? I had a Garmin GPS unit slide across the dash and out the open passenger window while aggressively taking a left turn in the car...had to back up, get out, and go pick the thing up. Still works just fine.

In PA, you can open carry without a permit, but not while driving, that requires a CCW permit.

In MO anyone legal to have a gun may CCW in the car, however one must have a ccw license outside of the car or home.

Every state will be different.
In Az...you can oc in your vehicle. You cannot leave your gun laying unholstered though. It can be anywhere in the vehicle as long as it's in a holster or box with some sort of latching device. It cannot be concealed in a purse or fannypack...holstered or not, unless you have ccw permit.
Without ccw, you can wear it, have it in the glovebox, under the seat, in the console, on the seat, dash, door compartment, anywhere you like as long as it's contained properly...loaded or not.

CA has some screwed up firearm transport laws...but that's no surprise to anybody.

Check with your local PD, they will be more than happy to advise you.

You cannot legislate morality, and banning inanimate objects will never substitute for personal responsibility. Banning and limiting things merely makes them profitable to criminals via laws of supply and demand.

I don't trust information from the local police departments without getting multiple opinions, especially on information that could leave me with felony charges. I have asked several questions to different PA police officers from various departments, some local, some state, and get different responses as to what the law actually is.

Ask a local lawyer then. I think it would be a good idea for regular CCers or OCers to have one on retainer and on speed dial.

how is it possible that your local police departments don't know the laws regarding weapon carrying? go to a library, pull the statute book, look it up and photocopy it...........I would certainly take the advise from the PD before a defense attorney or folks on an internet forum...... (many lawyers dont know the laws, I see it every time I'm in court)

Each state will have a website and you should be able to search for information by looking for "attorney general", "concealed weapon", etc. Most of their sites will include a PDF file that will have their states weapons laws. I keep a keychain drive with me when I travel to other states, and prior to going I download the local states weapons laws onto it. On the plane I study it and know their laws and whether my CCW will work their, what ammo is legal (you would be surprised), and whether or not, and how I can carry in a vehicle. They all differ quite a bit and my suggestion is to have a hard copy of what you learned with you in case you get stopped. Having a printout from THEIR website will defuse any problems IMHO.
