in an argument turned fight, isn't the person who throws the first punch the one going to jail?
and if you can talk the other person into putting on boxing gloves, doesn't it become a sporting event rather than a crime?

verm, can you explain that? Would the first person to throw a punch be the aggressor, and guilty of assault, whereas the other guy would just then be defending himself based on the escalated use of force (escalated by the other guy?)

It depends on the verbage used by the actors in their verbal altercation. If one is using "fighting words", ei. "your wife is a great lay" then I'm not taking the guy who knocked him out to jail.

Like TxCop312 said! You've got to think about the totality of the situation, and then heap some discretion on top of that. I'm pretty sure I could get almost anyone to punch me if I shot my mouth off enough. While that would be wrong on their part, it would not make me a victim. Arresting the fellow who rightfully clocked me will only encourage my behavior. With honest even fights, generally I take both (or all...) or none. Just my $.02

In most cases the answer would be no, no one would go to jail...as long as it was just a "fight" and did not escalate.....There are WAY WAY to many varibles that could come into play here...so there is no positive answer.....

if they were doing it for betting they get hauled in for some racketeering variant around here. (ie. fight club esqe thing)
