To amend title 18 of the United States Code to provide for reciprocity in regard to the manner in which nonresidents of a State may carry certain concealed firearms in that State.

IN THE HOUSE OF REPRESENTATIVES

Mr. HOSTETTLER (for himself, Mr. JONES of North Carolina, Mr. SESSIONS, Mr. WICKER, Mr. DOOLITTLE, Mr. WAMP, Mr. BURGESS, Mr. GOODE, Mr. SOUDER, Mr. GINGREY, Mr. PENCE, Mr. BARRETT of South Carolina, Mr. HALL, Mr. WILSON of South Carolina, Mr. CANNON, Mr. ADERHOLT, Mr. BARTLETT of Maryland, Mr. BRADLEY of New Hampshire, Mr. MCHENRY, Mr. FOLEY, Mrs. CUBIN, Mr. CANTOR, Mrs. MUSGRAVE, Mr. WESTMORELAND, Mr. BURTON of Indiana, Mr. OTTER, Mr. LEWIS of Kentucky, Ms. GINNY BROWN-WAITE of Florida, Mr. SODREL, and Mr. ALEXANDER) introduced the following bill; which was referred to the Committee on the Judiciary

A BILL

To amend title 18 of the United States Code to provide for reciprocity in regard to the manner in which nonresidents of a State may carry certain concealed firearms in that State.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `Secure Access to Firearms Enhancement (SAFE) Act of 2005'.

SEC. 2. RECIPROCITY FOR THE CARRYING OF CERTAIN CONCEALED FIREARMS.

(a) In General- Chapter 44 of title 18, United States Code, is amended by inserting after section 926A the following:

`Sec. 926D. Reciprocity for the carrying of certain concealed firearms

`Notwithstanding any provision of the law of any State or political subdivision thereof, a person who is not prohibited by Federal law from possessing, transporting, shipping, or receiving a firearm, and is--

`(1) carrying a valid license or permit which is issued pursuant to the law of any State and which permits the person to carry a concealed firearm; or

`(2) otherwise entitled to carry a concealed firearm in and pursuant to the law of the State of the person's residence,

may carry in any State a concealed firearm in accordance with the terms of the license or with the laws of the State of the person's residence, subject to the laws of the State in which the firearm is carried concerning specific types of locations in which firearms may not be carried.'.

(b) Clerical Amendment- The table of sections for chapter 44 of title 18 is amended by inserting after the item relating to section 926C the following:

`926D. Reciprocity for the carrying of certain concealed firearms.'.

Is this is a second version of the "Federal Carry" bill?

I'm all for concealed carry. But I don't like bills like these. The federal government needs to stay out of states business.

This would however force states like Kalifornistan to allow folks from out of state to carry here...in theory...LEOs are supposed to be able to carry anywhere now, but I have heard that several states are refusing to accept that law. What makes the Feds think this one is going to be any different?

It isn't an infringement on the states rights.

All it is doing is putting CCW licences in the same category as drivers licences.

Title 18 is the reason your out of state drivers license is honored in all other states. This bill just adds CCW to the list of items the states agree to honor.

how can I help to make this bill a possibility. I have written y senators and Governor and such often on gun laws and other stuff but continue to receive no response, as to there position or opinions. (read: IS THERE ANYTHING ELSE I COULD DO????)

danp, you are right about that. According to info from my retired website, the New York PD Commisioner states he will arrest any out of state leo, retired or active, who carry a gun in his city. He doesn't allow his active/retired members to carry outside the state either. NY City is a whole different country. Also, New Jersey doesn't allow hollow point bullets from what I understand. Don't know how they are on HR218 (National Carry for le)

I also heard Nevada (of all places) is not accepting HR218.

If I recall correctly, the NYPD memorandum advised their officers to detain any LEO or retired LEO until their status could be detained. While I don't like the anti-LEOSA tone of the memo, it doesn't really advise anything that isn't done already. Despite what Commissioner Kelly's memo implies, most NYPD officers are not going to be dragging many people into the station to verify LEOSA status.

While an agency can refuse to authorize its own officers to carry out of state, it has no authority to prohibit out-of-state LEO's/retirees from carrying in their jurisdiction under LEOSA. Arresting a lawfully armed LEO or retiree would be an unlawful arrest and probably a constitutional violation despite what Commissioner Kelly or the Mayor of Chicago may want to believe.
