Shot And Killed By Ohio State Trooper
Ohio State Trooper James Cress shot and killed drunken driving suspect Errol Baker II on Sunday. The entire incident was caught on tape by Trooper Cress's dashboard-mounted camera. For 82 seconds, Cress battled with Baker after pulling a gun he seemed hellbent on using. The trooper punched Baker several times, once causing him to drop the .45-caliber handgun. Baker retrieved the gun and fired, narrowly missing Cress. The trooper then grabbed his own gun, firing a fatal shot into Baker's head. The video released today seemed to dispel the Baker family belief that trooper Cress was unprovoked. Upon further search two bags of cocaine were found in Errol Baker's pocket. Baker had been previously indicted on one count of engaging in corrupt activity, 12 counts of trafficking in cocaine, one count of illegal manufacture of drugs, one count of discharging a firearm close to a home and two counts of possessing weapons as a felon.

Better eyes than mine are needed. I can only see what appears to be the trooper shooting the perp. Why doesn't the sound pick up the gun shots?

Looks pretty cut & dry to me, but I'm not an LEO or attorney. Of course, I'm also not a "the criminal has rights" person either. As for the sound, it is my understanding that the audio for these tapes is picked up by a lapel style mic. I suggest one of two things happened. A) Lapel mic gets covered during stuggle, prohibiting the audio from getting through, which explains audio for first 20-30 seconds, then none. B) (More likely the possibility) Whichever agency released this tape purposely deleted some of the audio for legal purposes. This therory also explains audio for the first 20-30 seconds, then none. Either way, anyone that fights with a LEO, then somehow gets a deadly weapon in their hands while not complying with said LEO's commands, deserves EXACTLY what this guy got. My $1.280's worth Mark

I haven't seen the video yet (stupid dial-up, I'm waiting to use the T connection at work tonight), but I have on initial question. If the bad guy had a gun, why waste time punching him? I don't want to Monday Morning QB him, but I certainly hope that is not the case. I worry that the current political atmosphere is making some LEOs hesitate a bit much before using proper force. I'm not saying it happened here, but in the video we were all looking at a while back of the Deputy who completely failed to engage until after he was shot at, I think it was a factor. Be careful out there guys. Don't worry about the lawyers, media or admin. Worry about you and getting home to your family.

What I see is the subject rolling over, then the gun is knocked out of his hand and to me it appears at about that same time the trooper quickly fires a shot. Looks like the gun quickly comes out, almost looks like the trooper is just moving his hand there.. right before he appears to relax and his hands come off the guy. And to add more to it, I don't think the officer knew he had a gun at the time, until the guy was able to roll over and pulled it out. At about that instant is where I think I can see the officer shoot him, almost simultaneously with the gun getting tossed out of the suspects hand.
At 1:40 into the clip, you can see the officer draw his weapon. I think that's when he first noticed the gun. About 1:43 is when it appears he fires the shot into the suspect. |

my lapel mike has a noise cancelling feature similar to those on electrnic hearing protectors. A "pop" is heard for each shot but the supersonic crack is reduced.
Having the mike on your shirt pressed against the bad guy's body also does little to enhance the sound quality. |
