CCW QUESTION FOR FL LEO

ok heres my question . i got pulled over today for doing 8 mph over limit . i know i deserve the ticket but hers the problem. when he walked up to the car i had the engine off with the keys on the dash board, all windows were down and had my DL and CCW out the window holding it for him . he looks at my ccw and asks me if i had the gun in the car i said yes . he asks where i told him on my left hip. he tells me to take it off my hip and unload the gun and lock the slide to the rear. he never asked for registration or insurance but asked for the mag and the round that was in the chamber. i obeyed his command and gave it to him but he then asks me what i needed a ccw for and what caliber and make of the firearm. i tell him i work in nuclear security and i filed for the ccw also that it was my springfield xd in 45 gap. he takes my mag and the round in the chamber to his car and starts to run my id but still has not asked for my insurance or registration. he comes back and gives me a ticket for speeding and then gives me my mag and round back and says sign here and have a good day.

as a leo have you guys been trained to do as i described above . when i been pulled over before all they ever asked was where the gun was and that was that . what im wondering is what is the proper way for this to be handeled by a leo cause i felt weird when he asked why i need a ccw for . thanks for your comments guys and gals

He had no right to ask you that. you shoulda said "cause its my 2nd ammendment right, and cause i can". He's a clown for giving u a ticket for 8mph over anyway.

Miami-Dade or somewhere in Broward. Anywhere else he sounds like a rookie as well as being dangerous. In the 'fore mentioned, sounds like local politics.

Any cop who would ask the occupant of the vehicle to down-load or even un-holster their personal and legal ccw is asking to get sued. All it takes is one accidental discharge.

8 miles over is just a bunch of BS, even if it is "officially" breaking the traffic code.

thats bad all the way around.....I would NEVER want a person handling their weapon, its stupid.....if someone is being searched and they say "I have a knife in my pocket" they dont retrieve it, the officer does, for OBVIOUS reasons....why put a weapon in someones hands...MORON

second, a ticket for 8 over....RIDICULOUS

third, a ticket to an armed fella working nuke security.....RIDICULOUS

if you didnt have a firearm with you, why would this copper think you gave him your card...duh

dumbasses like this give us all a bad name.....hes a boob, and if it was me, I'd tell him that too....(but then again, I can get away with it)

dont worry, chalk it up to him being a goof and dont let him spoil your ideas about the rest of us

belive me gents i dont hold it against you guys at all. i might not be a leo like you but i do understand your position on things. nogoa i live in saint lucie county so there not all up on the violence like dade and such areas with a high crime rate so i really didnt understand it . also i been told that you dont have to give your ccw to the officer when you get pulled over but i do just for the fact if they see it printing on me they dont pull there weapon or anything

the way I would do it is this, if I got stopped I would produce the DL, insurance, reg etc.....keep the ccw card off to the side, if asked if carrying a weapon, reply with the truth and produce the card at the same time...some guys may feel different, and thats cool too.....unless your state requires you to inform leo immediatley upon contact....then follow the law for your jurisdiction.....

I gotta differ with with Mike on this one. I want to know if the dude in the car has a gun in the car. What I do is ask where it is. If it's in the vehicle, and I can safely retrieve it without the driver or passengers getting out, I'll do so. Reason 1, to make sure the people in the car can't use the gun, reason 2, to run the #'s to check for stolen. It's AMAZING how many guns can be recovered that have been reported stolen. If the driver has it on him, I'll very politely ask them to exit the vehicle, and I will disarm him. I've never had anyone get upset at me for this, and most say that they understand and would probably do the same. It's all in the way you talk to people.

Then, when I go back, I give them the gun, then the mag, then the chamber round. If the guy is a real ratchet anus, I'll empty the mag and hand him back a handfull of bullets.

BTW, 8 mph over is practically expected in KY.

8 over, I wouldn't write that ticket. There are cops in my town that would.

As for how the officer handled the situation, I agree it was handled poorly. But I have ran across armed people. Usually, I just keep an extra eye on them. If they were giving me a funny feeling, I might have them step out and I'd take their weapon off of them. And like Hulk said, I'd run the serial number. I've never had to go that far, but I will in a heartbeat if I feel my life is in danger at any point. I would never ask them to retrieve their own weapon though. Just asking for trouble.

And I never tell anyone to have a good day after I write a ticket, that just makes you sound like an ahole.

As I've said before, I don't get real worked up when someone produces a CCW. I do appreciate being told that you have it. I don't expect that every LEO everywhere has that same standpoint. The only thing that changes when someone produces a CCW is that I call dispatch to make sure the CCW is legit. I keep an eye on them, but I have never had a CCW holder give me any issues whatsoever.

I don't write speeding tickets unless you REALLY need one, so 8 over on a CCW holder simply wouldn't happen. The last time I wrote speed was a 75 in a 25... and he tried to fight it! The judge just laughed.

I try not to Monday morning QB another badge, but that does seem a bit extreme. I agree with Mike (big suprise, right?) I would NEVER ask anyone who I don't know to handle any weapon. Generally if someone shows a CCW and asks what I want them to do, I respond that if they keep their gun on their hip, I will as well.
