AZ man sues police for 5.7 million dollars

In September 2008, an armed man fleeing from police broke into a Phoenix home. The homeowner, who had a weapon, cornered the man in a bedroom. Police arrived, and an officer shot the homeowner six times, leaving him with permanent injuries.

This week, a review board cleared the police officer of wrongdoing.

The injured man has, filed a multi-million-dollar lawsuit.

I predict any jury who hears this case may up settlement from $5.75 mil. Not knowing all the facts but what has been presented the PD was way in the wrong and should be held accountable. How this so called review board dismissed the officer of any wrong doing is beyond me.

I did not read the article but I can see a cop running in after the suspect and seeing a man holding a gun on another man and pulling the trigger. In my state, if Im in a stop n rob, I dont have to announce myself before shooting a BG in the back. If he is holding a weapon on someone else, he has displayed intent to inflict serious bodily hard or death.

You really should read the story. The man's wife told the police before they entered her husband had the bad guy at gunpoint in the house. And then they treated the husband and the family as if they were criminals and tried to cover it up some how.

"If Brian would have known there was a homeowner in there, he probably would have hesitated," Gannon said, "but if he had hesitated, and it was the (suspect), the outcome could have been tragic."

Umm, it was a house. Therefore, high probability of a homeowner. And the outcome WOULD have been tragic? What the Fudge do you call it when a cop shoots a perfectly legal homeowner defending his family in the back? And twice after he's on the floor? If this ain't tragic, I'd like to know what is.

The cops failed to communicate (at least one knew the homeowner was holding the BG at gunpoint and failed to share).

The cop who shot fired because he heard screaming and "thought" he saw the hispanic guy they were looking for. And thats grounds for shooting him? He thought he saw the BG and so he opened fire?

And who moves an injured man, who is injured by your mistake (not to mention criminal act I think) by dragging him through his house by his leg?

Sounds like the police dept better get a pen and their checkbooks ready.
