local gun shop is giveing me a deal!! but...

i was going to have him over night me a XD.40 but he said he has some being sent to him in a week that he can sell cheaper right at 50 bucks "thats 5 boxis of ammo " he said he can sell them cheaper because he orderd them from a gun show or something. has any one heard of gun stores doing that? could he be passing off a used gun as new or what?

Yes, gun shops get guns from everywhere. It could've been at a different shop who sells more Glocks than XDs or something.

A used XD is easily distinguishable by looking at the end of the barrel for the famous "ring" that is on it from firing. Just give it a good look-over. Its nearly impossible to get all the crud off a fired gun, look closely and you'll be able to tell pretty easily.

You should be wary. I had a shop (Magnum Sports here in NY) try to pass me off a USED 1911 as new.

The guy says, "well, you can always get aftermarket barrels for these...".

I break the thing down and the rifling is not only dirty, it's also shot to sh-t.

Give it a thorough runthrough and a white-glove inspection if he says that it's new. If he has a problem with that, then don't buy it. "It's not that I don't trust you, but...I don't trust you".

IIRC passing a used gun off as new is a federal offense. Much more important that crud on the gun is where exactly was the gun used. It would suck to find out the hard way that your supposedly new gun was involved in something illicit.
