correct me if I'm wrong, but even if a person doesn't sell something, it's still copyright infringement if you make shirts with their logo, isn't it?

After a little research...

From the Copyright act of 1976:

Quote:
Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include—
  1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
  2. the nature of the copyrighted work;
  3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
  4. the effect of the use upon the potential market for or value of the copyrighted work.
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.
So, for example, take a t-shirt that you copied a logo on to. You made it for yourself for your own use and are not selling it or copies of it to your friends. It would seem to me that this is not of a "commercial nature." I would also say that your creation of the t-shirt would not devalue the XD handgun itself, or the market for the XD -- in fact, it may attract people towards the brand as it is basically free advertising. I guess I don't see the big deal, nor do I see why Springfield would attempt to sue a person over use of the logo on a single t-shirt.

But, I am not a lawyer and this shouldn't be taken as legal advice.

Why do they stop me from being able to copy a dvd that I purchase then? I don't know, maybe copyright laws are different when it comes to other products. I don't want to copy a dvd or cd to make money off it, or to give a copy to othes, but instead to have a backup i can use so I can keep the original in good shape so it lasts. but that's illegal to do, as far as I know.

Actually, a backup copy of music for personal use would be "fair use" under the current copyright act. Sadly, the DMCA of 1998 excludes DVD movies because they are encrypted. Check out this CNN article for a detailed explanation in layman's terms.

I would not be selling them, I would put them up here so you could go to a place like CafePress and make your own shirts for your own personal use.

PS: Use of the logo for non-commercial purposes (i.e., personal use), is protected by copyright law, so don't be worried about getting sued.
This sounds like an awesome idea. I think that would be very cool.

when one copies a dvd why do they copy it, because they do not want to buy it or they want to sell it thus impacting sales of the dvd. however you are creating a t-shirt wich is not a replacment or subsitute that would affect the sales of the xd, related apperal, also would not degrade the SA as a company, you wuld not have any reprcussions of that

The way the copying of dvd's/cd's works, is IF you own the original, it is perfectly legal to make a backup copy for yourself, as long as you don't sell it, or distribute it to other people... When you BOUGHT the dvd, you bought the license to do with it what ever you want, as long as it only concerns YOU, and not others...

Response from SA

Here is what I got when I emailed SA about some new XD Wear.....

In addition to the white XD t-shirt with the pistol on back and XD .45 ACP 2006 NRA Handgun of the Year t-shirt, Springfield Armory has Black XD (SA XD) polo shirts, black/red XD sweatshirts, hooded black/red XD sweatshirts, and XD black leather jackets. They are not currently advertised but they are available for purchase. You can call us at 800-680-6866 to order. Let me know if you have any additional questions or concerns.

Thank you,
