I keep both my XDs in a quick-access safe next to the bed. I'd open it up, give one to the wife, and have her call 911. I'll grab the other one and the surefire that I keep next to the safe, and walk out the bedroom door. All the upstairs bedroom meet at one spot, and that spot is also the top of the stairs. I'd simply stand at the top of the steps with the XD45 pointed down them. Anything steps into the staircase, it gets light up, and shot if need be. Nothing downstairs is worth me getting shot over.

If I didn't have a kid in the other room, I'd stay in the bedroom and train on the door.

As far as the family of the BG hiring a lawyer to sue you, it has happened before. For instance, here was the FIRST result from a google search of "burglar sues homeowner":

Accused Burglar Sues Homeowner Who Shot Him

Must have missed your little friend comment. Anyway, unfortunately things like that do happen...in states that don't have deadly force laws. Like someone said earlier you should really know your laws before acting. Read the link that I provided earlier and it states that deadly force can be used without fear of prosecution and lawsuits. Dead issue. Missourians have nothing to worry about which is what I had been saying this whole time.

Well obviously, many of us don't live in Missouri. I never stated that I was talking about Missourians specifically either. I didn't realize this thread only applied to people in your state. I guess I should read more closely from now on.

Luckily, the justice system (namely the judge) has a good head on their shoulders:

Judge dismisses burglar’s lawsuit -- GazetteXtra

But the question you need to ask, is the possibility of getting sued by the BG worth risking your or your family's well being? If all else fails the 10th response on your link works well

I was simply making the point that even if the BG is dead, there is still the possibility of being sued and bogged down with legal fees and time in court by that person's family.

However, the thought of possible legal problems would never stop me from protecting my family from a real threat.

I can see your point, but the alternatives are less appealing. The whole thing about it is no one has control (within reason, and excludes peeps who leave $50k in cash spotlighted just inside the window of their home) of where and when the BG is going to choose to break in. It's a matter of chance and circumstance, so if you are unlucky enough to be the chosen one then hopefully the law will be on your side when actions are taken. Best thing would be to make your home/apt/castle/etc the least favorable target and hope for the best.

Well it's that you'd be charged with any criminal offense. Not that at all. You can always be sued in civil court. That where the PITA takes place. Now you'd probably still win, but the castle laws just protect you from being criminally charged with a crime. Heck, my neighbor can sue me for peeing on the side of my own garage.

They have rounds that are like a bird bomb or something like that. (its kinda like a warning shot) So you can cover your butt and say you gave him a warning first then shot. I don't think you need to tell them that the 2nd round(being your SD ammo) came right out after the first. So if some tries to take you to court.
