(R1) May nonimmigrant aliens legally in the United States purchase or possess firearms and ammunition while in the United States? Nonimmigrant aliens generally are prohibited from possessing or receiving (purchasing) firearms and ammunition in the United States. There are exceptions to this general prohibition. The exceptions are as follows: 1. nonimmigrant aliens who possess a valid (unexpired) hunting license or permit lawfully issued by a State in the United States; 2. nonimmigrant aliens entering the United States to participate in a competitive target shooting event or to display firearms at a sports or hunting trade show sponsored by a national, State, or local firearms trade organization devoted to the collection, competitive use or other sporting use of firearms; 3. certain diplomats, if the firearms are for official duties; 4. officials of foreign governments, if the firearms are for official duties, or distinguished foreign visitors so designated by the U.S. State Department; 5. foreign law enforcement officers of friendly foreign governments entering the United States on official law enforcement business; and 6. persons who have received a waiver from the prohibition from the U.S. Attorney General. Significantly, even if a nonimmigrant alien falls within one of these exceptions, the nonimmigrant alien CANNOT purchase a firearm from a Federal firearms licensee (FFL) unless he or she (1) has an alien number or admission number from the Department of Homeland Security (formerly the Immigration and Naturalization Service) AND (2) can provide the FFL with documentation showing that he or she has resided in a State within the United States for 90 consecutive days immediately prior to the firearms transaction. [18 U.S.C. 922(g)(5)(b) and 922(y), 27 CFR 478.124, ATF Rul. 2004-1]

I'm ALWAYS amused when folks post, with an air of total authority, on subjects about which they obviously know little-to-nothing.
At least two members have posted that it's FEDERAL law that one can neither own nor possess (without supervision) a handgun, if one is under 21. Whatacrocka CRAP!!! One may not purchase a hangun from an ffl unless one is 21; however, it's perfectly legal to buy a handgun in a private sale and to possess that handgun, without any supervision, if one is under 21. Several states even issue concealed carry permits to 18-yr-olds, Indiana comes to mind. Anybody think the states would issue a permit to do something that's against FEDERAL law?? JHC! Get your facts straight, guys! |

The government in general is counter intuitive, medical mj license is a permit to use a plant thats illegal under federal law (does anyone lower than a GOD have the right to ban something that naturally grows in the ground?). Laws don't have to make sense, they just have to CONTROL YOU, sadly enough.
I think you're right about the 18 year olds getting CHLs, I know I've heard something like that before. Texas citizens in the military, between age 18 and 21, can get CHLs (I read that on one of the sites you guys gave me

This was 8 years ago;
My best friend, who is French/Canadian with a green card (immigrant visa), wanted to buy a Sig P239. We are here in Texas. He had to do the wait but was sold the gun no problem. Although he is well over 21. He has since received his American citizenship (after me bitching at him for 11 years). So I guess 21 and up LEGAL immigrants can buy a firearm/pistol in Texas. The only problem is he never shoots it. I bet he hasn't shot, cleaned, or oiled that Sig in 6 years. I can only do so much. You can't help a lazy person that won't get off his a$$.

I'll admit my facts may have been a little skewed as to the minute particulars but the general jist was there.
What I think is even funnier is when people post the same information 3 times 3 different ways and it gets interpreted in 3 different ways. No one here has stated their credentials or where they get there information from therefore it is implied heresay. The OP already stated he would contact a lawyer so this should be a dead issue. |
