As ive understood the new law (i agree with the out of reach for the old, and controversially worded one for safeties sake) the weapon does NOT need to be out of reach, but DOES need to be concealed (as youve stated).

edit: and i forgot to add, while im sure its not what the DPD officer was thinking of (or in reality wants you to know), nor does it probably help you...BUT none the less ..... you can OC on your own property and it would be perfectly legal.

I appreciate the help guys, I will consult with a professional (either at DPS or a lawyer) and see what they tell me. She only has one more year to go, so hopefully we can just wait. I should get my first firearm in the next 2 months or so hopefully I don't need it before then.

Texas Gun Ownership and Possession

Gun Ownership/Possession.
Handgun, minimum age 21.
Long Gun, minimum age 18.
Not a convicted Felon.
This is Federal Law.

Car Carry
Long Gun - open, loaded carry is allowed.
Handgun - concealed, loaded carry is allowed.

Personal Carry
Long Gun - open, loaded carry is allowed.
Handgun - concealed, loaded carry is allowed with Concealed Handgun License (CHL).

You are not required to register Firearms and they are not tied to a CHL. You can purchase and give as a gift or sell to anyone, but you better make sure they are of proper age and not a convicted felon. Suggest using a FFL to complete the transaction or the other person be CHL.

Well..something I can help out with based on firsthand knowledge.

I'm a Canadian citizen, originally here in Texas under a work visa, but now in the process of getting a green card, as I married my wife, a US Citizen.

Here's what I experienced on firearm purchases...

1. You have to be 21 for handguns
2. You need to have proof of residency, such as drivers license which has your current residence listed, and/or 90 days worth of utility or phone bills which show your current address and the applicant's name.
3. You need to have your I-94 card and passport. You cannot apply to buy a firearm for 90days from your point of entry into the US (based on your I-94). Part of the background check is the FBI checking with DHS on your date of entry, etc.
4. You need to have a valid Texas hunting license...it's odd, but that's the case.

First time I applied, I didn't realize that the 90day rule was based on last entry date, so the background check failed. Second time I applied after I reached 91 days, and the background check came back cleared in 20minutes. It also seems to depend on the store...places like Academy, etc sometimes have issues dealing with the requirements, whereas a dedicated gun store knows exactly what to do.

I travel a lot and often need to find specific laws for places that I go. I usually do as much reading as I can then call the Stale Police for some clarification and ask them some specifics. Many times I can find out what is legal as well as what tends to be enforced, which sadly isn't always the same thing.

Can carry concealed in your car without license...within reach (will more likely result in prosecution if you're in one of our big cities)

There are very few laws regarding long guns in Texas.

Her being an immigrant... I have no idea... Consult with a lawyer for sure.
