This could be bad, but anyways...
Ok, so I've been reading about the ability of taking a factory XD 40S&W magazine and using it with 9mm rounds. The only reason this interested me was a 'skirt the law' thought.
If in a state where you can only have a 10 round magazine you carried a XD9 with a 40S&W 10rnd mag loaded with more than 10 9mm rounds you would be breaking the law. I have yet to see a 40S&W mag, but from the one floorplate photo it looked like it wasn't marked as 40S&W/10rnd, is the back of mag marked with the round count up to 10 as well? My thought was this - if you had to show your weapon to someone looking for a hi-cap they would only see a magazine marked as a 10 rounder on the back, right? Until they start popping the rounds out, then you are in loads of trouble, of course. ...and if you just happen to be in a situation where you were forced to dump a mag at someone and they counted the brass during the crime scene you'd get into more trouble. Keep in mind this is just a hypothetical post here, I have NO intention of doing this... it's just much easier to carry 10+1 and an extra mag than to have a non-standard altered magazine. Thoughts?

Although I'm not a LEO, I would bet that if they went to the trouble to check your magazine for any notation their next step would be to count the rounds. They would be doing it for a reason and most likely complete the task of checking the weapon.

the few times that I have checked I just look at the mag. and where do you live? I assume californiastan?

The removable baseplate says what caliber the magazine is for.

This was what prompted me (on the FAQ)

The XD40 magazine you are referring to has the basepad marked "40S&W 10rd". It has the indicator holes as well as the numbers 1 - 10 next to the corresponding holes marked down the rear of the mag. For all intents and purposes, there is no reason you cannot own that magazine. You could have 100 of them in your range bag and not have a single problem. You don't even have to own an XD40 handgun.
BUT... IF you had those mags loaded to more than 10 rounds each and you were to be checked, I'm sure you would get more than a perplexed look on the officer's face. Why risk something like that? In Cali, you would probably be facing a felony and then you would no longer be able to own a firearm or at least not be able to own one for a good long time. So, its probably better to have 3 mags loaded to 10 rounds each than to have two XD40 mags loaded to 15. It just aint worth it. |

No no, not worth it at all... and again to restate I am NOT asking in order to do this. I just own a 9mm and have not seen a 40S&W mag other than what is on the FAQ... just curious.
I'm stuck with 10 rounders one way or another, just need to get a few more...and NO not those horrid pro-mag ones.
