Minor embarrasment

Had my birthday dinner tonight at a really nice restaurant with my mom and stepdad tonight. This place serves $32 filets, $17 tuna salad, and braised rabbit. I had the $20 sirloin with pineapple on top. nice place. they've even paid me $50/hr to play music there. So we're out on the patio, next to a guy with crutches. About halfway thru the time there i hear something hit the ground. i think one of his crutches falls over. not the case. about 30 seconds later the waiter comes over, says "I think this is yours" all while handing me my magazine. i suppose i hit the mag release on the chair and didn't feel the mag drop out of my pistol. it was carried behind my hip OWB.

Complete embarrasment.

I walked back inside to the men's room and reinserted the mag. I certainly hated having someone tell me i dropped it on the ground and was surprised that no police arrived. after all, he didn't know about my CCW lic. In my estimation now I think I'll be done playing there just from that little incident. I've told a few owners about my ccw lic but I do not carry when i'm in a place that only sells alcohol or has more than 50% revenues from alcohol. i always ask...

How often of an occurence is this??

Did they not sell alcoholic drinks there??? If so their revenue is still probably 50% or more from the drinks. I have noticed that in some places it says you can't carry in a place that sell for consumption on premises and then again in another paragraph throw in the 50% revenue rule. So not matter what you cannot carry where alcoholic beverages are sold.

You are luck the police didn't get called, But then again not everyone is a gun hatin liberal hack.

That's interesting. Personally I think a fine dining establishment is an appropriate setting to carry. In CO, if the police were called, I do not think you would have been accused of carrying in an inappropriate environment, but you might have been cited for showing. But given the circumstances, I doubt even that.

Honestly, I don't think the police would have stormed the place were they called, but an officer (maybe a detective, given the environment) might have approached you and asked you outside. After explaining the situation and producing your permit, I'm sure he/she would consult their office and then simply asked you to be more careful.

Interesting topic, the reason I say so is I know a guy who is an ex-cop and now he bounces at a bar in a rough area of town for extra spending money and he carries. This is in Alabama granted but how does he do it being that all the revenue made from this place comes from alcohol.


Is it the ex-cop under the table thing or can an employee/bouncer/tender/whatever carry?

Ex LEO's have alot of pull in situations like that. More than likely this guy knows that if something should happen where he is questioned on his carrying in a place that sells alcohol, he'll just have to say hey I used to be a cop, I always carry... Said and done.

That said, at least you got out of the situation without any problems. Seems like the waiter was an understanding fellow.

What I found was this.

carry a pistol in a vehicle or concealed on or about

year from date of issue, if it appears that the
applicant has good reason to fear injury to his
person or property or has any other proper reason
for carrying a pistol, and that he is a suitable
person to be so licensed...
This appears to be in line with SD statues.

23-7-8.1. Form and contents of permit. The form of the permit to carry a concealed pistol shall be prescribed by the secretary of state pursuant to § 23-7-8. The permit shall list the applicant's name, address, and the expiration date of the permit. The holder of a permit may carry a concealed pistol anywhere in South Dakota except in any licensed on-sale malt beverage or alcoholic beverage establishment that derives over one-half of its total income from the sale of malt or alcoholic beverages. Nothing in this section prevents law enforcement officers, security guards employed on the premises, and other public officials with the written permission of the sheriff from carrying concealed weapons in the performance of their duties or prevents home or business owners from carrying concealed weapons on their property pursuant to § 22-14-11.

Basically, security guards employed by the business in question and anyone the sheriff gives written permission to can carry in a bar. I'm pretty sure that the guy in question being an ex-cop doesn't hurt matters.

Perhaps you should have informed him of your CCW license, especially if you thought the police were going to arrive any moment. Are you certain he even knew what it was? And if he did, did he know it had previously been attached to a weapon?

I'd also be sure of your state laws as to whether it's illegal to carry in such a place. In my state, it's not, but is illegal anywhere if you're drinking.

ouch, that reminds me of a buddy of mine, he is a colonel now in the sheriffs dept (harford county md is one of the only counties in md that has a full service sheriffs dept and no "police") anyway, when he was startin out 25 years or so ago they were still using revolvers. he was just patrolling one night and noticed two guys sitting in a car in front of a liquor store, it was like 2 am so he pulled up to check it out, he approached the car and started asking questions, as they were trying to come up with answers he notices a shoe box with the lid half open and a gun inside, now he is sure they were about to break in. he goes to put his hand on his revolver and notices it isnt there, so he acts all calm, says he is just gonna go back to his car for a min. and when he gets back he saw that it was just sittin there on the seat. apparently back then the holsters they issued didnt do too much to keep the gun intact and it had just slipped out of the holster while driving.... but how much does that suck? atleast you didnt notice it was gone when you needed it!

It sounds like the place is gun-friendly. No one panicked and called the cops on you. That's a good thing!

I don't think so. Your permit is between you and the police, should they appear. Also, telling him about a "gun permit" when he didn't ask would only make him suspicious or worried, or make you look stupid. Don't mention your gun or refer to it in any way, unless asked about it directly, and even then, use discretion.
