Need Some Advice
Hi everybody. I live in a "residential community" where I pay rent and have an apartment. In my lease, buried in there, it does say "no guns", (as well as pets, but they allow pets). I have a SA XD-45 that I know I'd put in my car if they wanted to do an "apartment inspection" (with a 24hr notice, which they've never done). Recently though, because of a few police incidents, they have hired a security service to check people in, and patrol the apartments (I live near a university). My situation is that it seems like I am not allowed to have a firearm in my apartment or even in my car because of a quiet, but existing "no firearms" policy. But for some reason that doesn't really sit well with me. I have a Nevada CCW, and Nevada also has a silent gun-in-car policy, but I know I'd get busted on by the rent-a-cops if they saw or found my gun. As of now I keep my firearm in a lockbox near my bed, as always, but does anyone know if I could argue that if they found it, or should I just stash it in my car and have a less useful firearm? I hope that made sense.

I wouldn't have moved in their, thats my response to the legal side
to the practical I ask this have you changed the locks on the house? they can't search your house if you change the locks on them, also is the rest of your gear for your xd hidden away? |

if it were me, I'd say screw them and keep the damn gun in my apartment.
I don't see how they can deny you your constitutional right when you pay to rent the property. It's your home, not theirs. I say screw them and let them come find your gun if they want to. I seriously doubt if they did an inspection, that they'd be going through all your belongings to find things. Those inspections are more just to make sure there aren't any leaks, you aren't taking care of the apartment in bad way.. things busted up, etc. |

What people can't see won't hurt them. That said use good judgement in where you keep your firearm and how you lock it up. Also does it say they can inspect your personal property anytime they want? Most likely NO. The inspection rules are probably a 24 hour notice type thing or emergency situations like water leaks. If you think they might be going through your personal property you need to SUE THE CRAP OUT OFTHEM! Also as long as you are using non-descript shooting bags or other items that don't show off the fact that you have firearms in your place I don't think you will get kicked out but just to be on the safe side start looking for a new place.

That'd probably be the best way to get out of the situation, but that's not going to happen. They also want the keys if you change the locks. To clarify, they aren't going to randomly come in, it's just to make sure you haven't broken through a wall or are going to start a fire. When it comes to my xd gear, I say **** 'em if they find it. As of now I am not doing anything differently. I guess the main problem is where do my rights to private property begin and where does it end. Even in the unlikely event I get in trouble for it, what can they do? They don't have a "no firearms" sign at the front. It's just that pesky "No firearms" note in the lease. I just wanted to see what others had to say, because I have my CCW, and keep it on me, but I can't have it in my own apartment. Screw that. Yeah, I'm treating it as a "don't ask, don't tell" deal, but I'm not losing any sleep over it. Thanks.

Keep your guns, the only time they'll ever know you have them is if you need them to protect your life. At that point nothing in your lease matters anyway.

As long as people put up with this it will only get worse....
Move somewhere else tell. Tell them why. On a side note but related, I was shopping for homeowners insurance recently for a new home I was purchasing... Not only do prices vary GREATLY....a trend now is for the company to tell you how much to insure it for... Well, what they say is ....our research says that it would cost XXXXXXX.00 to rebuild your home in the event of a total loss. When you push for any other -read less- amount.......many won't do it. I had one rep with the worse people skills of the bunch get rude with me....It is one thing to say sorry but this is the minimum amount the company will let me offer you...but this guy said...."this is the way we do it and this is the least amount we will insure it for" I said no....NO you won't insure it at all. It is bad enough that 90 percent of the insurance companies run credit reports for rate basis....a few still do not. I made it a point to explain to everyone in the industry I spoke with that 1: I will not be told how much to insure my property for. I am required only to cover the mortgaged amount. 2: The reason I am doing business with you is you still have good policies. It is sad the organizations whether it be insurance or the apartment management thinks they are right by making these policies legal... Legal or not; it is wrong. Only when enough people have taken their MONEY elsewhere will there be a chance for change. Yes, I am opinionated. I am outspoken. I am passionate. This country has gone to Hell and people will eventually wake up and see they have NO rights and cry and moan that they wish it hadn't happened....when their complacency is what allowed it. |

place webcams around the house, then stick a sign by your front door on the inside... notifying all who enter they are under constant surveillance.
they most likely cant under any circumstances search through your drawers, or personal belongings.

They most likely put that note in your lease so they can kick people out if there is gun-related trouble in the apartment complex. That might make the tenants feel better, but I would be thinking about criminals who know about the lease. Be glad they don't post a sign!
Personally I would move, but since you can't do that, just don't worry about it. The worst thing they could do is kick you out and keep your deposit for violating your lease. I would suspect you could beat them in court over that. You could probably sue them now, but that would take money and time.
