Transporting to Different State
Alright I have spent two days looking into this and hav'nt found anything yet.
I am from Buffalo, NY but im stationed in NC in the Military. I bought my xd45 here in NC. I am planning on driving home to NY in March. I want to bring my 45 home so I can go shoot with my Dad at the range, and of course personal protection on the 14 hour drive. I do not have a Concealed Carry Permit.. YET. Is this going to be legal to do? Im not that Familiar with NY's gun laws. Anybody have any insight on this??

I think you will be legal IF you leave the gun, unloaded and in the trunk.

When I moved to NY about five years ago, the law was that I could not cross the state line with a handgun, unless I had a permit for NY state. As the requirements for the permit included a residency period (which I didn't qualify for) and character witnesses in the county that I resided, I couldn't bring any handguns across from Pennsylvania.
For you, it may be quite different. I assume that you having a house in NY means that you grew up there, have sufficient residency, and probably have a few character witnesses to aid getting a permit. Since you mentioned being stationed in NC, there may be an active military exemption. Now I'm in California, and they have an active military exemption, as well as a transversal exemption. Since we're on the left coast, there isn't much point in the transversal exemption unless you are cutting a corner between Nevada, Oregon or Arizona. Because you actually intend to stay in NY, I think you may be SOL on this one man. You need a permit just to OWN a pistol in the Peoples Republic of NY. I pray that I never get stationed in Ft Drum!
If I understand correctly, safe passage, or whatever it's called, is only if you're traveling through the state on the way to another destination. No good if you're staying there. It also generally means that the weapon must be unloaded, out of reach, with ammo stored separately. As far as personal protection, what are you, stupid or something? That's what the cops are there for! Best place to check is here: http://www.packing.org/state/ They have great info on everything. Something I do highly recommend is that you print out the applicable laws for each state you're traveling through. I've met some cops who were pretty ignorant on their own gun laws, and every once in a while, you get one with his own ideas on gun control. Good luck!

I hate to break the bad new...and I am not going to waste my time typing information that can be found elsewhere...ie NYS Penal codes on their website...or even packing.org, BUT...
NO. You would be breaking the law. A permit is needed! Unless you are only traveling through NY, then I would not bring my pistol. Sorry! Anyway, I live in Buffalo (Amherst) ...PM me when you get back if you are in need of a shooting partner!

One other thing occurred to me, just in case you think you might be able to sneak by. I've been stopped eight different times in NY by all sorts of LEO's. I've never once got as much as a single speeding ticket. I'm not sure if this is a statewide thing, but there appears to be a very low bar for probable cause. Usually, it seemed that the officer was bored, and I just happened to be driving by at the moment of boredom.
Why do I bring this up? Well, they've been very thorough every time in examining all of my paperwork and asking questions about, and actively looking for possible drugs, alcohol, and firearms. As a returning member of our military, if you are stopped, they will know your status, and may have more suspicion than normal that you may be transporting an un-permitted handgun. -- Len |

What job do you have in the USCG? I know someone in the MSST and they are federal law officers so he can have his CCW anywhere anytime. You command may have paper work to fill out and give you the same ablity

Dang it. Im not moving back to NY im just taking 2 weeks of leave to visit the fam. My dad argued with me for an hour the other night about the gun laws. I guess he won that one.
Oklawall: I am a Boarding Officer, which makes me a Federal Law Enforcement Officer and a Customs Officer... While on official duty. I have never heard of a BO being able to carry while off duty. Im putting my FL CCP in as we speak. It still wont help me with carrying it in NY. I like the state but the anti-gun politcians gotta go!
