ThePainkiller, I wonder why you think this is an "accidental negligent discharge". I the guy put a bullet in the chamber and fired it, then that is a negligent discharge. It may not be intentional, but it's still negligent. Now if you could show that his gun has a problem, like it fired upon releasing the slide, then maybe. But still I follow the same rules for shooting when loading the pistol just in case that should happen. At some point that gun was loaded or being loaded and was pointed in your direction. That's negligence or plain stupidity, not an accident.

Call me narrowminded but the only situation that I would consider an AD is when my gun is pointed downrange on a target and I fire off a round too quickly. Any other time, be it during cleaning, carrying, putting it on the nightstand, handing it to somebody, or reloading it with my best friend standing in front of me it is a ND. Sure, it was accidental, assuming I an not actually tryiing to give my buddy a scar he can show show off, but it is also negligent. I think we just need to be careful about saying "accident" as a safe, neutered word for negligent.

You guys are right. The only reason I lean toward A or ND is the fact, neither of us are 100% sure how it went off. I didn't see it and he doesnt know. All I saw was a flash a hole in my wall and powder filling the room. Im not in favor of thinking that the gun went off on its own, but he does not remember having his finger on the trigger. I dunno why I wasn't furious, if it was my friend cortland, he would ahve pistol whipped josh. This surely isnt my first brush with death, maybe Im used to it lol

Get your friend in a safety course ASAP. Please make a note that it is a bad idea to have any gun out and available while other people are in the house. It seems for the undoctrinated (untrained) that the finger goes to the trigger automatically when the gun goes in the hand. I still have to constantly remind myself - off target, off trigger - on target, on trigger.
When I took youngest son to the range for the first time I was always reminding him also.

The XD would need the failure of 3-4 parts and one of them to just disappear for it to magically go off without anyone touching it and then it wouldn't function afterwards.
Your friend picked up the gun, gripped it and pulled the trigger. end of story.

I have to agree with everyone else here. There are mechanical failure accidental discharges, such as the few times I've known guns that went off when the safety was disengaged (man are those scary--yet another reason to train yourself to work the safety when you are pointing the gun where it needs to be, not before). There are no setting the gun down while playing with it accidental discharges. Those are clearly negligent, especially on a gun with a trigger and grip safety.
