I didn't mean "these things happen, no biggie" like he just spilled milk on the carpet. It was very serious, and I let him know it. But, he's not the first person in human history to do this, nor is this a mistake by amateurs. It happens. Perhaps it would have been better to say "Sh*t Happens...learn from it." In any event, he wasn't flashing his gun around at the party, it was my roomates party. Honestly, no one in the party heard the gunshot even though they were in the next room. Well, they didn't ask about the noise.

"Hey what was that noise dude?"
"What noise...hand me another beer!"

Oh, and neither of us were drinking. Thats a big rule in my book. When Im drunk, I can barely operate a salad fork. But yes, from now on, I will be watching him very close around weapons. The only person you can safely trust with a gun is yourself. Permitted you follow the rules. And I have a hole next to my headboard to remind me each day.

Ditto dstorm1911's comment. There's not much to say that already hasn't been said. You two are VERY fortunate that you aren't looking at large blownup pictures in a courtroom demonstrating why this WAS NOT an accidental discharge.

Also, my compliments for sharing this event though - everyone who read it found it sobering. I've never had any use for a man who plays with a weapon. My jaw is still on the ground.

I was about to post exactly what dstorm1911 posted (minus me being an AZ LEO). It would be VERY hard to prove and ND with a gun with the kind of safety features inherent in an XD, and I dare say up here (in Canada) you'd be hardpressed to find a judge or jury you could convince otherwise with.

Then again with our judicial system, murders routinely walk out serving a very small portion of their sentence - you'd more likely get more time for tax evasion...

You seem to be ignoring that for this "discharge" to come within inches of your back and what it take to discharge a XD he was almost certainly taking a BEAD ON YOU in playing with his gun. Anyone that does "show and tell" with a gun at a party has a lot of learning about the lethal nature of guns.

I did have a roommate that when he was ready for the party to end, and wanted to go to bed, would put his unloaded shotgun on his shoulder and start walking around asking everyone if they'd seen his cleaning kit or would just starting cleaning it on the living room couch. Worked like a charm everytime. Parties ended in minutes.

ND = Negligent Discharge = Near Death

If one of my close friends ever did that, I'd 1. beat them senseless, 2. suggest they take a training class and 3. find a new close friend.

My brother "muzzled" me with an Air-Soft and I had the urge to pound on him.

I'd walk behind Josh if I were you. Definitely do not walk in front of him.

A wise man learns from other's mistakes. I have tried to teach my oldest son this, but he insists on making his own.

had it happen

Well, I've had a similiar incident happen to me. I was my college dorm when my friend came over. He had just purchased a new .380 and wanted to show it to me. Anyway it was some cheap european made thing I don't remember the make. It had a "decocker" on it, and when he went to perform this function the gun went off. Slinging a hydro-shock round into my room-mates bed. It went through the 2 pillows, matteress and the round stopped in the frame work of the box spring. Now my girl friend heard it 1 floor down, but thought it was some find of fireworks. Luckily for us no one was hurt and the campus police never came. Anyway he took the pistol back the next day and they sent it back to the manufacturer and found a problem with the decocking mechanism. I was pissed.

+1 on that. Guns (99.999999% of the time) don't just decide to fire. It was an ND. No AD, no "AND". Your friend was screwing around with a loaded gun and you alsmost got shot becuase of it. He may be your best friend in the whole world, but don't minimalize what he did and try to sugar-coat it with a new term like "AND".

If it was me that almost took one in the back, my ex-friend would be tossed out of my place so fast he wouldn't know how he ended up on the sidewalk. That would be after I took the gun away from him. Hell, I would probably call the cops (if they weren't called already) and give them the gun. Let your buddy explain to them why he should be allowed to lawfully posess a firearm after he pulled such a bonehead move. May seem a little harsh, but I've never been accused of being the forgiving sort of person, especially if someone almost just shot me because of pure stupidity.
